ISSUE:
Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed revision of regulations described in this report?
BACKGROUND:
Regulations 1052 and 1053 are currently entitled, "Requirements for Course Certification" and "Course Certification Request and Review Process" respectively.  Historically, Regulations 1052 and 1053 were established to address course certification requirements and the course certification process in regard to instructor-led course certification.  As the demand for self-paced training delivered online to the law enforcement community increased, POST responded with the commitment to continue to develop and make available such training.  

In August 2006, the Commission approved an amendment to Regulations 1052 and 1053 that included language to establish procedures and requirements for certifying self-paced training courses.  At this time POST was one of the few developers of this type of law enforcement training. 

Since then POST has received inquiries regarding certification of self-paced courses, instructor-led courses delivered online, and webinars.

While the language added in August 2006 to Regulations 1052 and 1053 in regard to self-paced training course certification assisted in guiding certification of this type of course, the language was limited and caused confusion to course developers and presenters.

A committee comprised of a cross representation of POST bureaus was established to review the two regulations which resulted in Regulation 1052 being dedicated to address Instructor-Led Training Course Certification, and Regulation 1053 being dedicated to address Self-Paced Training Course Certification. All courses delivered on-line that include instructor interaction, either synchronously (instructor online with the students) or asynchronously (instructor interacts with the students at a later time), were considered instructor-led for the purposes of certification.

Regulation 1001 was revised to include the definition of "Learning Activity" that is referred to in both Regulation 1052 and 1053.

The Self-Paced Training Course Certification Request form (2-124) was revised, and a Self-Paced Training Subject-Matter Expert Resume form (2-121) was developed to be consistent with the proposed revisions in Regulation 1053.

The majority of the changes were to clarify and simplify language and to address each category separately and distinctly.  
ANALYSIS:
The proposed changes to the Commission Regulations 1001, 1052 and 1053 and the amendment of POST form 2-124 and creation of POST form 2-121 (Attachments A through D) are intended to ensure the POST Administrative Manual (PAM) is comprehensive in describing regulatory requirements and is user friendly for the law enforcement community served by POST. 

The proposed revisions to Regulations 1052 and 1053 clarifies the regulatory requirements for POST certification of courses. The revised regulations alleviate confusion regarding what constitutes an instructor-led course and describes what is required of a presenter to submit an instructor-led or self-paced course.

Regulation 1001 was amended to include a definition of "Learning Activity" as used in Regulation 1052 and 1053.

Changes to Regulation 1052:
  • Defines instructor-led training and instructor-led training course certification, including courses presented in a classroom setting or delivered online with instructor interaction, synchronously or asynchronously. 
  • Describes the process for certification of conferences.  Previously there was no regulation regarding how to prepare a certification package for single-track (training delivered to attendees at one time) or multi-track workshops (attendees select individual workshops). 
  • Requires agencies to add to the expanded course outline, a description of all learning activities that will be used during course.  Learning activities may include: role playing, viewing and discussing scenarios, and participating in table-top exercises. The use of learning activities allows the instructor to assess student learning. 
  • Clarifies the information required for course certification when the presenter submits the material to POST through the Electronic Data Interchange (EDI). The amendment applies to certification requests for an instructor-led training course certification and for the instructor-led portion of a blended learning course.
  • Defines a live webinar as an instructor-led course and outlines the requirements for submission of a webinar for certification.  Primarily the presenter must be able to confirm student attendance and course completion, describe the means for students to interact with the instructor, and verify student learning. Taped webinars will not be certified.
Changes to Regulation 1053:
  • Specifies the course certification criteria for self-paced courses, including use of the amended POST form 1-124 and the new POST form 1-121. 
  • Describes POST's internal review process for self-paced courses.  Training Delivery Bureau (TDB) staff will preliminarily approve a course based on the presenter establishing an unmet training need. TDB staff will review the certification package for content and instructor qualifications. Learning Technology Resources Bureau (LTR) staff will review the course for instructional design and functionality.
The revised regulations and self-paced course submission forms were reviewed and approved by the Instructor Standards Advisory Council (ISAC) and various training managers.  
RECOMMENDATION:
Staff recommends the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed revision of the regulations described in this report.
