ISSUE:
This is an informational report. The topic of respiratory protection for law enforcement was discussed in a report to the Commission at its February 2012 meeting. Staff has been working on addressing the issues and has held meetings with CAL/OSHA staff to clarify the enforcement issues and training requirements.
BACKGROUND:

In 2004 POST released the Model Respiratory Protection Program for Law Enforcement to aid agencies in establishing guidelines to satisfy Title 8 – §5144 of the Code of California Regulations (CCRs). The guidelines need to be updated to conform to changes in §5144.    In addition to §5144, CAL/OSHA adopted §5199 dealing with protecting law enforcement employees from Aerosol Transmissible Diseases (ATD). Attachment A outlines the requirements of §5144.

 

CCR Title 8 – §5144, which regulates respiratory equipment, requires development of a written policy for an agency program, appointment of a Program Administrator, annual medical surveys, annual equipment fit testing, regular inspection and maintenance of issued equipment, and both the initial training and annual training for all personnel who are using Air Purifying Respirators (APRs) or Powered Air Purifying Respirators (PAPRs).
ANALYSIS:
The needed update to the Model Respiratory Protection Program for Law Enforcement is just one part of the necessary updating and review and is fairly complex and technical in nature. Staff at CAL/OSHA will be working with POST and other interested stakeholders to identify and clarify the information that needs to be included in the guidelines. It is anticipated that a draft set of guidelines will be presented to the Commission at its October 2012 meeting.
