ISSUE:
Should the Commission authorize the Executive Director to revise Regulations 1070 and 1082 of the POST Administrative Manual to include an instructor course requirement for reporting writing instructors pursuant to the Office of Administrative Law (OAL) rulemaking process?
BACKGROUND:
At the October 2012 Commission meeting, a request to revise Regulations 1070 and 1082 of the POST Administrative Manual to include an instructor course requirement for reporting writing instructors was approved. Since then, staff identified potential impacts of the requirements for instructors of in-service Report Writing classes.  Contact with the agencies that offer in-service report writing courses disclosed that some courses have not been offered for years. For the courses that are active, staff detailed the plan and rationale for the proposed changes in regulations with the affected presenters. Overall, there is consensus in support of the revisions to Regulations 1070 and 1082.

 Minor content changes were made to clarify regulatory language. In addition, a later implementation date has been identified in order to allow presenters ample time to meet the revised regulatory requirements.
ANALYSIS:
The recommended changes to Commission Regulations (see Attachment A) include:
  • 1070:   Minimum Training Standards for Instructors of POST-Certified Specialized Training
  • 1082:   Minimum Content Requirements for Instructor Courses
The changes were reviewed and approved by the Consortium Advisory Council, the Consortium of Academy Directors, and the presenters of the modular format of the Regular Basic Courses. If no one requests a public hearing, the revisions will become effective February 1, 2014.
RECOMMENDATION:
Staff recommends that the Commission approve the proposed revisions consistent with the attachment language and authorize the Executive Director to revise Regulations 1070 and 1082 of the POST Administrative Manual to include an instructor course requirement for reporting writing instructors pursuant to the Office of Administrative Law (OAL) rulemaking process.
