In approving the Consent Calendar, the Commission accepts the progress report and recommendations from staff concerning the Strategic Plan.
3.Report on the Status of the Pilot Study of Driver Training in the Basic Course
At its October 2008 meeting, the Commission received the Driver Training Study, Volume I  and approved implementation of the recommendations in the report. One of the recommendations was to enhance driver training curriculum in the Regular Basic Course (RBC).  

The Commission directed the implementation of an academy-based program which would incorporate four components into Learning Domain (LD) 19 Vehicle Operations :  Law Enforcement Driving Simulators (LEDS), a speed component, night driving and the use of interference vehicles. The applicability of these recommendations to peace officer basic training is to be determined through the use of a pilot project developed by POST in conjunction with a committee of subject matter experts.  

During several meetings with subject matter experts a review of the Training and Testing Specifications (TTS) for LD 19 was conducted and modifications of the TTS were reviewed and approved by the Commission. Those changes went into effect on January 1, 2012. As a result of the changes to the TTS the committee revised the LD 19 Workbook which was made available to academies on the same date.  

The committee reviewed the Commission recommendations and developed additional TTS for the pilot. They include three new requirements for exercise tests (night driving, interference vehicle and a speed component), in addition LEDS was included as a Learning Activity.  Additionally, the current grading forms for vehicle operations were revised and refined to be exercise specific and to include a speed component and interference vehicles, as required by the Commission. The new forms are being validated by the pilot academies.  

While the pilot process is progressing the Basic Training Bureau is infusing driver awareness in the RBC and in the Field Training Officer (FTO) / Police Training Officer (PTO) Programs. The concept of tactical seat belt removal is now a component of scenario testing and the FTO / PTO Programs. Over-driving ones ability or driving beyond the headlights was added to LD 23 Crimes in Progress. As Workbooks are updated lessons learned from Driver Training Study, Volume I will continue to be added.

4.Report on Prevailing Trends in Standards and Training
Pursuant to Strategic Plan Objective D.2.08, a futures planning capability was established within POST in order to to enhance the quality of the strategic planning process. During June 2011 the POST Future Vision Team’s initial report was reviewed and approved by the Commission. At its October 2011 meeting, the Commission requested that a futures report be prepared and submitted annually. Thus, a second report, entitled Prevailing Trends Report – June 2012, has been prepared for Commission review. The report identifies prevailing trends; examines current conditions; considers what opportunities, threats, allies, and competitors may exist in the environment; presents an example scenario of what POST could resemble over the course of the decade ending in 2020; and offers recommendations for attaining a preferred future.

5.Report on SPO C.10.08, Conduct a Comprehensive Review of the Supervisory Course and Curriculum
The mandated 80-hour Supervisory Course was last updated in 2001-2002. At its April 2008 meeting, the Commission approved implementation of Strategic Plan Objective C.10.08, “Conduct a comprehensive review of the Supervisory Course and curriculum.” Primary areas identified for updating included leadership and the series of video vignettes depicting a fictitious team of personnel the new sergeant/supervisor would be expected to supervise. It was also recommended that greater depth of understanding about the situational leadership model be provided.  

New video vignettes focus on leadership development, including contemporary issues such as social media, painkiller addiction, impact of shrinking budgets, rapid technological advances, and diversity in the work force. Course PowerPoints, handouts, group exercises, and individual assignments have been revised. POST web designers created a Supervisory Course Network to enable instructors throughout the state to share innovative ideas, videos, materials, and student exercises. Situational Leadership II® concepts, which provide a more accurate representation of the manner in which the majority of individuals and teams progress and develop in today’s workforce, have been interwoven throughout the course.

The Commission approved the updated course content at its February 2012 meeting. Numerous workshops have been conducted to familiarize the cadre of Supervisory Course facilitators with the updated curriculum and materials.

In approving the consent calendar, the Commission adopts the staff recommendations to delete Strategic Plan Objective C.10.08 as completed.  
6.Report on SPO A.08.08, Expand Entry-Level Cognitive Testing for Peace Officers
This is a report on efforts to update and expand the POST Entry-Level Law Enforcement Test Battery (PELLETB). In April 2012, the final phase of the longitudinal study concluded its determination of adding a new sub-test to the PELLETB and possibly removing the CLOZE sub-test. Results from the study suggest that POST should discontinue the CLOZE sub-test and incorporate measures of fluid reasoning abilities into the PELLETB. Further, findings show that the removal of the CLOZE test and addition of the fluid reasoning measures will add significant value in predicting success in the academy.

7.Report on the Learning Domain 18 Investigative Report Writing Project
This is a report on the status of the Investigative Report Writing project. Effective July 1, 2012, the Training and Testing Specifications were revised to require that the newly developed and validated Learning Domain (LD) 18 Investigative Report Writing test form will be used by Regular Basic Course presenters when evaluating students’ performance. Report writing subject matter experts met and have developed scripts/scenarios on various topics. To ensure the content, validity and integrity of the training videos, these scripts will be reviewed by subject matter experts in the areas Laws of Arrest, Search and Seizures, Use of Force, Vehicle Pullovers, and Domestic Violence.

8.Report on SPO B.15.10, Regarding the Development of a Quality Assessment Process for POST-Certified Courses
Strategic Plan Objective B.15.10 directs staff to develop methods to “ Effectively assess the quality of courses and instructors. ” Since January 2011, POST staff and subject matter experts have met to formulate evaluation instruments and methodologies, conduct pilot tests of the evaluation processes, perform data analysis to inform of  revisions. New course and instructor evaluation rubrics have been developed to assess instructor performance and the quality of POST-certified courses. A new Course/Instructor Evaluator training course has been piloted to train managers and evaluators in the use of the forms. The evaluation process and forms are being field tested in training courses throughout the State. A recurring contract is in place to provide regular opportunities for trained evaluators to review and evaluate POST-certified courses utilizing the new evaluation procedures.

It is anticipated this Strategic Plan Objective will be completed and the Quality Assessment program will be ready for implementation in June 2012. This system of instructor and course evaluation completes Strategic Plan Objective B.15.10. Staff will recommend this item for deletion at the October Commission Meeting.

9.Report on Cal EPA Grant Funding for Environmental Crimes Training
The Cal EPA is required by statute to transfer funds to POST for the purpose of advancing environmental enforcement training. Over the last several years, POST has utilized these funds to develop an environmental crimes course for the Learning Portal, a telecourse, and a classroom-based course.  

Staff is currently working in partnership with staff from Cal EPA to develop a symposium on environmental crimes training, to be held in San Diego, October 16 – 18, 2012. Two planning sessions have been held consisting of environmental crimes prosecutors, investigators, and regulators to focus on symposium design and curriculum. Staff has contracted with the San Diego Regional Training Center (SDRTC) to present the symposium. The theme of the symposium will be “Collaboration, Partnership, and Integration in Environmental Crimes Enforcement.”

10.Report on SAFE Driving Campaign
The SAFE Driving Campaign met May 1 – 2, 2012, in San Diego with the Vehicle Operations and Training Advisory Council (VOTAC), Advisory Board, and Research Team. Approximately 50 individuals from throughout California and the United States discussed various aspects of Situation-Appropriate, Focused, and Educated (SAFE) driving campaign for law enforcement officers. The next meeting will occure in November 2012.

Since the last report to the Commission, POST staff launched the SAFE Driving News Alert which has nearly 2,000 subscribers. This News Alert is specific to the SAFE Driving Campaign and provides recipients with links to training materials, news articles, research studies, videos, and other information. A Motorcycle Subcommittee has been added to the VOTAC. Its focus is the advancement of best policy and training practices for law enforcement motors.

11.Report on POST Developed Training for Peace Officers on Post-Traumatic Stress Disorder
In September 2010, SB 1296 (Correa) was signed into law, adding Penal Code Section 13515.36, which requires POST to create a training course for peace officers on how to recognize and interact with persons suffering from Post-Traumatic Stress Disorder (PTSD) and Traumatic Brain Injury (TBI) .  POST formed a workgroup comprised of subject matter experts that include the California Department of Veterans Affairs, the U.S. Veterans Administration, UC San Francisco General Hospital Department of Neurology, and appropriate community, local, and state organizations and peace officers with expertise in the area of PTSD and TBI.

Beginning in June 2011, the workgroup met to review existing training that incorporates these topics in the curriculum, including Crisis Intervention Training (CIT). Based on the review, workgroup members determined a training need exists and began development of a course outline. The project transitioned to development of a DVD course to facilitate widespread distribution to California law enforcement agencies. As required by the penal code, the DVD and a report on statewide training will be submitted to the Legislature no later than June 30, 2012.

12.Report on the Model Respiratory Protection Program for Law Enforcement
At the February 2012 Commission meeting staff presented a report on the Model Respiratory Program for Law Enforcement developed in 2004 to address issues surrounding Cal OSHA and enforcement of CCR Title 8 – Section 5144. The 2004 guidelines needed of updating to provide agencies guidance about assessing respiratory protection masks that were issued to their employees.

POST staff has held two meetings with Cal OSHA staff enlisting support for updates to the  guidelines. It will take time and resources to accomplish all of the tasks involved in updating the guidelines and providing a sample policy that complies with Cal OHSA requirements and regulations.

POST staff and Cal OSHA representatives will meet with stakeholders in July 2012 to begin the revisions that will provide guidance to POST agencies statewide.  The guidelines will be ready for Commission review at the October 2012 meeting.

13.Report on the SAFE Driving Symposium
The SAFE Driving Campaign is aimed at reducing fatal and serious injury law enforcement traffic collisions. SAFE stands for Situation-Appropriate, Focused, and Educated driving. “Situation-Appropriate” recognizes the need for officers to modify their driving for varied situations and for trainers, supervisors, and chiefs or sheriffs to establish and reinforce what is appropriate for their agency. “Focused” addresses the many concerns related to roadway position, distraction, fatigue, and multi-tasking. “Educated” refers to both training and policy, and the need for officers to apply what they learn from these areas to their driving.  
 
POST has been holding meetings with stakeholders since 2009 to share information and explore ways to reduce officer traffic-related fatalities and serious injuries. These meetings with the Vehicle Operations and Training Advisory Council, the Research Team, and the Advisory Board have made significant progress and now staff is preparing to present the work of this collective group to constituents in the form of a training symposium.  The symposium will take place October 9 - 11, 2012 in San Diego.

14.Report on the Crowd Management Summit
POST hosted the 2012 Crowd Management Summit in San Diego March 20 - 22, 2012.  Over 350 law enforcement professionals attended the summit. A series of panels presented different views of crowd management. The panels consisted of law enforcement chief executives, city managers/elected officials, experts in technology, and attorneys discussing legal issues and updates on mutual aid processes and procedures.

The summit included a presentation on the updated POST Crowd Management and Civil Disobedience Guidelines.  Staff solicited input on what should be the next step for POST on the issue.  That data is now being analyzed by POST staff.

15.Report on Academic Summit to Bridge Law Enforcement-Community Stakeholders Understanding of Protests and Demonstrations
As a result of the recent Crowd Management Summit, the Executive Director identified a gap in understanding between law enforcement personnel and community stakeholders involved in various protests and demonstrations reviewed at the Summit. Through discussions with academic researchers and POST stakeholders, a concept was developed for a second summit facilitated by academic experts that would focus on enhancing common understandings across law enforcement and community stakeholder groups. The intended outcome would be an incubator-style change process wherein key representatives would benefit from productive dialogue that would spread and support improved relations in future interactions between law enforcement personnel and groups involved in First Amendment activities.

A working group comprised of POST staff; California State University, Sacramento (CSUS) Associate Professor Kevin Wehr; Washington State University, Spokane Professor Bryan Vila; and Defense Advanced Research Projects Agency (DARPA) Program Manager Dr. Brian Lande has been assembled. The summit is tentatively planned for Spring 2013. The Summit is envisioned to be a CSUS event in conjunction with and sponsored by POST.

16.Report on Courses Displaced by the Closure of the Department of Justice Advanced Training Center
Prior to the closure of the Department of Justice (DOJ), Advanced Training Center (ATC) on March 1, 2012, POST staff conducted a review of all ATC certified courses to determine if alternative presenters should be identified. The audit disclosed that many of the ATC courses have not been presented for at least four years and/or there are other certified presenters for many of these courses.

The DOJ requested that POST continue funding presentations of eight of their existing courses through a continuing contract. On February 23, 2012, the Commission approved a $554,784 contract for FY 2012-13 with DOJ to present eight POST-certified courses.

Starting in FY 2012-13, POST will deliver, as part of the ICI program, three other courses currently certified to DOJ.

17.Report on SPO B.16.12, Develop an Interactive, Multimedia Version of the POST Student Workbooks
This report recommends POST develop an interactive, multimedia version of the POST Student Workbooks as a Strategic Plan Objective (SPO).  The new format would provide for more learning modalities, accelerate distribution of content updates, and realize cost savings for cadets. Staff will develop two Learning Domains as a pilot of this new format to test the effectiveness of multimedia based Student Workbook. If the pilot is successful, the full set of Workbooks will be developed in this new format upon Commission approval.

Staff recommends that the Commission add SPO B.16.12 to the Strategic Plan.

B.Report on Proposed Changes to the Training and Testing Specifications for Peace Officer Basic Courses

As part of an ongoing review of Peace Officer Basic Course content, POST staff and curriculum consultants (academy instructors and other subject matter experts) thoroughly review Learning Domain (LD) content to determine if revisions are necessary. The Training and Testing Specifications and supporting materials for the Learning Domains have been updated to reflect emerging training needs, compliance with legislatively mandated subject matter, changes in the law, or to improve student learning and evaluation. 

The proposed changes affect the following Learning Domains:
  •  LD 37, People with Disabilities
  • Minimum Content and Hourly Requirements - Requalification Course
  • Minimum Content and Hourly Requirements - Regular Basic Course (RBC) Modular Format – Module I

C.Report on Proposed Changes to the Aviation Security Course

In April 2011, Basic Training Bureau (BTB) staff met with Subject Matter Experts (SMEs) to review the 40-hour Aviation Security Course. Airport peace officers employed with agencies participating in the POST program are required to complete the course within 90 days of  employment (Penal Code 832.1).

 

BTB staff and SMEs are proposing changes/updates to the Minimum Standards for Legislatively Mandated Courses (Regulation 1081(a)). All nine blocks of instruction have been revised to better reflect the current needs and trends of aviation security. Seven of nine blocks were re-titled.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report. If no one requests a public hearing, the changes will become effective January 1, 2013.

D.Report on Proposed Changes to the Field Training Officer Course

In February and June, 2011, Basic Training Bureau (BTB) staff met with Subject Matter Experts (SMEs) to review the 40-hour Field Training Officer (FTO) Course. FTOs of agencies participating in the POST program are required to take the course every three years.

 

BTB staff and SMEs added a block of instruction focusing on how a FTO should evaluate, train, and monitor the trainee in the safe operation of a law enforcement vehicle in both general patrol and emergency situations. Tactical seatbelt removal, the need for ongoing training, and Situation-Appropriate, Focused, Educated (SAFE) driving were also addressed, as directed by the Commission at its October 2008 meeting. The new material was incorporated into the topical area of “Driver Safety,” which was added to the course content listed in POST Procedure D-13-4.

CENTER FOR LEADERSHIP DEVELOPMENT
E.Report on Augmentation of FY 2011-12 Contract for the Sherman Block Supervisory Leadership Institute

The Sherman Block Supervisory Leadership Institute (SBSLI) was presented initially in 1988, and its popularity as a value-laden program for enhancing leadership has steady grown. The program’s popularity has necessitated placement of candidates on a lengthy waiting list, in some cases requiring them to wait as long as 18 months to gain entry into a class.

 

A two-pronged effort is proposed to expedite the admittance of applicants into the SBSLI and also reduce, or eliminate altogether, the waiting list. The first action is to increase the class size, from the current number of 24 students to 26. The second action is to add three additional classes to the FY 2011-12 schedule. This augmentation will require funding in the amount of $279,976, which entails increasing the current contract amount from $2,043,357 to $2,323,333. This increase in funding will be only for FY 2011-12. The expanded class size will continue.

 

If the Commission concurs, the appropriate action would be a MOTION to authorize the Executive Director to augment by $279,976 the existing SBSLI contract with California State University, Long Beach, bringing the total contract amount for FY 2011-12 to an amount not to exceed $2,323,333. (ROLL CALL VOTE)

COMPUTER SERVICES BUREAU
F.Report on SPO C.14.11, Request to Contract for Development and Implementation of a Computer Based Testing System to Replace TMAS
The Testing Management and Assessment System (TMAS) was developed eight years ago by a vendor following a competitive bid process. The system uses Internet-based technology to deliver POST tests to proctored testing locations throughout California.  TMAS has been updated to address some functional and usability issues.  However, the system’s security model has not changed since implementation.  The TMAS system was not designed to address newer and more common technical threats, or to accommodate new security technologies as they are developed.  These factors have increased the risk of compromised tests.

 

In June 2010, the Commission directed staff to contract for the completion of an Information Technology Feasibility Study Report (IT FSR) and Information Technology Procurement Plan (ITPP) to replace TMAS with a modern, enhanced testing system. The resulting FSR was approved by the Department of Finance on December 21, 2011. The ITPP was submitted to the Department of General Services on April 24, 2012.

 

Staff has performed significant market research on configurable off-the-shelf (COTS) computer-based testing software, and concluded that modern offerings provide much-improved security features and ease of set-up and use.  If this item is approved, a competitive bidding process based on comprehensive POST requirements will be initiated to select the product that best fits POST’s needs.

 

If the Commission concurs, the appropriate action would be a MOTION to authorize the Executive Director to contract for products and services necessary for the acquisition, configuration, implementation, and verification of software to replace POST’s current automated testing system in an amount not to exceed $2,739,560.  (ROLL CALL VOTE)

LEARNING TECHNOLOGY RESOURCES BUREAU
G.Report on Request to Contract for Learning Portal Hosting, Support, and Maintenance Services
POST contracts with a private vendor to provide the operational services that support the Learning Portal. This includes hosting of courses, tools and training videos, updating code to support additional browsers, and addressing technical and usability issues. The contract also allows for periodic enhancements to the Portal’s functionality as well as updates of the user interface for better usability.   
 
The current contract expires December 31, 2012. This is a request to pursue a new contract to continue these services.   
 
If the Commission concurs, the appropriate action would be a MOTION to authorize the Executive Director to enter into a contract for up to three years with an appropriate entity to provide hosting, support, and maintenance services to sustain the POST Learning Portal in an amount up to $498,510. H.Report on Request to Contract for Management Fellow in Support of the Video Training Program

At the June 2010 meeting the Commission authorized a contract with a governmental agency for a management fellow to fill the training video program coordinator position.   

 

This management fellow is currently directing the program through an extensive transition and redesign of the training video product in response to a field survey and bureau analysis. The extension of the management fellow will ensure consistency as the project is being prepared for release to the field.  

If the Commission concurs, the appropriate action would be a MOTION to authorize the Executive Director to enter into a two-year contract with a governmental agency for a management fellow to administer the training video program in an amount not to exceed $292,206.  (ROLL CALL VOTE)

I.Report on Request to Contract to Complete Learning Portal Courses
In FY 2009-10 the Commission authorized the Executive Director to enter into a contract to develop two online courses that meet legislative or regulatory mandates for an amount not to exceed $500,000. 
 
POST entered into a contract with Allen Interaction, Inc. and began development in May, 2010. Progress on the development was delayed significantly due to the late State budget approval for FY 2010-11, and the vendor’s unexpected restructuring of their development team.
 
The funding has passed the three-year deadline to be expended. The original funds have reverted and the current contract cannot be extended.
 
This is a request is for approval to pursue a new contract to complete the two courses.

MANAGEMENT COUNSELING SERVICES BUREAU
J.Report on Request to Contract for Web Based Computer Services for Management Studies
The Management Counseling Services Bureau (MCSB) is responsible for conducting management studies pursuant to Section 13513 of the California Penal Code. A major component of these studies is “Patrol Workload Study.” These studies require a computer workload program. The program MCSB currently uses is an obsolete “DOS” based software program, which no longer meets the requirements or needs of MCSB.
 
MCSB must contract for a new computer service to better address the needs of the law enforcement community and meet the mandates set forth in Penal Code section 13513. MCSB proposes to contract with Corona Solutions or another qualified vendor for a web based computer service that meets all of the requirements to complete a professional and accurate patrol workload study.
 
If the Commission concurs, the appropriate action would be a MOTION to authorize the Executive Director to enter into a contract with Corona Solutions or other qualified vendor to provide a patrol workload study web based computer service for a period of two years in an amount not to exceed $178,800. K.Report on Request to Contract with Management Consultants
The Management Counseling Services Bureau (MCSB) is responsible for conducting management studies for law enforcement agencies.  Penal Code section 13513 assigns this responsibility to POST.
 
MCSB has been understaffed for the past 3 years.  Primarily, the under staffing came about because of the hiring freeze imposed on state agencies.  For a period of time, MCSB only had one assigned consultant.
 
As a result, MCSB has amassed a large backlog of management studies and the bureau requires additional staff to meet the legislative mandate.  MCSB is requesting the Commission to authorize funding, to allow staff to contract with management consultants to eliminate the existing backlog of studies.
 
If the Commission concurs, the appropriate action would be a MOTION to authorize the Executive Director to enter into a contract with management consultants to conduct studies for law enforcement agencies over a two-year period in an amount not to exceed $300,000. (ROLL CALL VOTE)

L.Report On Augmentation of FY 2011-12 Contract for the Entry-Level Dispatcher Selection Test Battery
The Commission previously authorized that the mandated Entry-Level Dispatcher Selection Test Battery be made available to agencies in the POST program at no cost. Due to limited staff and equipment resources it is necessary to contract with an outside vendor for this service. Cooperative Personnel Services has administered the POST Entry-Level Dispatcher Test Battery in an efficient and timely manner during the last eight fiscal years. The current FY 2011-12 contract was initially approved for $116,474.51; however, as test administrations have increased over the past few months, the original amount needs to be augmented. The new amount, not to exceed $174,750.00 remains an overall cost savings and will allow POST to continue to provide this service to the field.

M.Report on Request to Accept VAWA Grant Funds and Contract for Presentation of VAWA Courses

In August 1997, the Commission approved acceptance of a Violence Against Women Act (VAWA) law enforcement grant.  Since then, the Commission has continued to accept VAWA grant funds to develop and present training to law enforcement personnel on domestic violence and sexual assault.

 

Staff anticipates receiving $437,660 in VAWA funding for FY 2012-13 from the California Emergency Management Agency (Cal EMA). Since 2005, this grant has required an in-kind and cash match equal to 25% of the total project. For FY 2012-13, POST will be required to provide a match of $145,887, which will be met by equipment purchases and upgrades, curriculum updates, instructor travel, and training reimbursements. This will bring total VAWA program funding to $ 583,547 for FY 2012-13. Staff recommends accepting the VAWA grant funding, providing the in-kind and cash match, and contracting with the San Diego Regional Training Center (SDRTC) or another public or governmental entity in an amount not to exceed $437,660 to facilitate the course presentations and management of the grant program.

N.Report on Request to Contract for a Management Fellow in Support of the Public Safety Dispatcher Program

POST has developed training and selection standards to enhance the professionalism of public safety dispatchers for more than 25-years. POST has expanded its commitment to meeting the needs of public safety dispatchers and raising the bar, through creation of the Public Safety Dispatcher Advisory Council (PSDAC), addition of a PSDAC representative to the Instructor Standards Advisory Council (ISAC) and addition of a PSDAC representative to the Commission’s Advisory Committee. 

Over the past 18 months, POST, in conjunction with its public safety dispatcher stakeholders and advisory groups, has focused on expanding in-service training and development opportunities for public safety dispatchers. This has been accomplished through the creation of a Public Safety Dispatcher Program within the Training Program Services Bureau that was staffed by a retired annuitant. Primary activities included expansion of the Instructor Development Institute to include dispatcher-specific offerings (approved by the Commission in February 2012) and development of pilot courses such as "The Public Safety Dispatcher’s Role in Officer Safety" and "Handling In-Progress Calls and Active Shooter Incidents". 

Beginning in July there is a need for a skilled public safety dispatcher professional to coordinate the various components to develop a full-service program. Therefore, staff is seeking approval to contract with a public entity to secure a Public Safety Dispatcher Management Fellow initially for one year at a cost not to exceed $140,000.

The Institute of Criminal Investigation (ICI) enters into recurring annual contracts with specific training entities for the presentation of ICI courses. The ICI program makes advanced training available to criminal investigators to meet specialty assignment needs in law enforcement agencies.

 

In March, 2012, the California Department Of Justice (DOJ) Advanced Training Center, was closed and most POST contract training courses were eliminated. It was decided that the most appropriate program to incorporate the Narcotics and Officer-Involved Shooting Investigations Training courses was the ICI program. Each of these courses have been presented by DOJ to investigators for more than 20 years, and, as evidenced by attendance rates, continue to remain in high demand.

 

Staff contacted existing and potential new ICI presenters across the state to identify interested entities, and then determine those most capable of providing intensive, scenario-based training. Staff met with San Diego Regional Public Safety Training Institute (SDRPSTI) to assess this possibility and ensure understanding of the strict ICI requirements. SDRPSTI is a POST-certified presenter and has agreed to accept the responsibilities required to deliver ICI training, to include:  five offerings of Narcotic Investigations and three offerings of Officer-Involved Shooting Investigations courses. The source of funding for these courses is redirected from the unused allocation for the presentation of former DOJ contract courses. Staff recommends certifying these presentations to SDRPSTI.

Staff contacted existing and potential ICI presenters across the state to identify interested entities, and then determined those most capable of providing intensive, scenario-based training. Staff selected three existing ICI presenters that have agreed to increase course offerings, as follows:

  • Sacramento State University, College of Continuing Education – three offerings of Officer-Involved Shooting Investigations courses;

 

  • State Center Regional Training Facility, Fresno – five offerings of the ICI Narcotic Investigations Course;

 

  • South Bay Regional Public Safety Training Consortium – three offerings of Officer-Involved Shooting Investigations courses; one additional course offering for the Sexual Assault and Financial Crimes courses, and two additional ICI Homicide course offerings. Also, the Financial Crimes course requires increased funding to provide students with critical training tools. 

 

The request for the increase in existing ICI courses is due to the high demand and year long waiting lists to meet this training need. The source of funding for these courses is from a portion of the existing, unused allocation for the presentation of courses formerly supported through the contract with DOJ. Staff recommends increasing presentations as outlined above.

COMMISSION APPEAL HEARINGS
Q.Report on Appeal to Commission by International Training Resources (ITR)

On July 21, 2011, Officer Michael Short, Visalia Police Department was injured while attending a POST certified training course at the old Fort Ord military base in Monterey County. The course, Distraction Device Breaching – Instructor (CCN 1025-33566-11-001), was presented by International Training Resources (ITR). The injury sustained by Officer Short occurred when the detonation of a distraction device resulted in him being struck in the head and upper body. He lost one eye and sustained facial injuries.

 

POST conducted an investigation into the incident and concluded that ITR had deviated from the approved course, used instructors not approved by POST, did not have proper licensing for the use of explosives, and failed to follow proper student safety protocols.

 

As a result of the investigation, POST staff notified the presenter of the course that all courses (22 at the time) presented by ITR were decertified; that no training in any of the courses could be started or presented in any manner after 5:00 p.m., October 28, 2011; and that the partners of ITR were prohibited from participating in any POST-certified training course as instructors, coordinators, safety officers, or instructional aides or assistants.

 

Subsequent to the action taken by POST staff, ITR appealed to the POST Executive Director to have the sanctions lifted. The appeal was denied by the Executive Director. This decision resulted in the partners of ITR appealing the decision to the Commission.

 

If the Commission concurs, the appropriate action would be to hear the appeal of International Training Resources and render a decision consistent with the requirements of Commission Regulation 1058.

In approving the Consent Calendar, the Commission accepts the progress report and recommendations from staff concerning the Strategic Plan.
3.Report on the Status of the Pilot Study of Driver Training in the Basic Course
At its October 2008 meeting, the Commission received the Driver Training Study, Volume I  and approved implementation of the recommendations in the report. One of the recommendations was to enhance driver training curriculum in the Regular Basic Course (RBC).  

The Commission directed the implementation of an academy-based program which would incorporate four components into Learning Domain (LD) 19 Vehicle Operations :  Law Enforcement Driving Simulators (LEDS), a speed component, night driving and the use of interference vehicles. The applicability of these recommendations to peace officer basic training is to be determined through the use of a pilot project developed by POST in conjunction with a committee of subject matter experts.  

During several meetings with subject matter experts a review of the Training and Testing Specifications (TTS) for LD 19 was conducted and modifications of the TTS were reviewed and approved by the Commission. Those changes went into effect on January 1, 2012. As a result of the changes to the TTS the committee revised the LD 19 Workbook which was made available to academies on the same date.  

The committee reviewed the Commission recommendations and developed additional TTS for the pilot. They include three new requirements for exercise tests (night driving, interference vehicle and a speed component), in addition LEDS was included as a Learning Activity.  Additionally, the current grading forms for vehicle operations were revised and refined to be exercise specific and to include a speed component and interference vehicles, as required by the Commission. The new forms are being validated by the pilot academies.  

While the pilot process is progressing the Basic Training Bureau is infusing driver awareness in the RBC and in the Field Training Officer (FTO) / Police Training Officer (PTO) Programs. The concept of tactical seat belt removal is now a component of scenario testing and the FTO / PTO Programs. Over-driving ones ability or driving beyond the headlights was added to LD 23 Crimes in Progress. As Workbooks are updated lessons learned from Driver Training Study, Volume I will continue to be added.

4.Report on Prevailing Trends in Standards and Training
Pursuant to Strategic Plan Objective D.2.08, a futures planning capability was established within POST in order to to enhance the quality of the strategic planning process. During June 2011 the POST Future Vision Team’s initial report was reviewed and approved by the Commission. At its October 2011 meeting, the Commission requested that a futures report be prepared and submitted annually. Thus, a second report, entitled Prevailing Trends Report – June 2012, has been prepared for Commission review. The report identifies prevailing trends; examines current conditions; considers what opportunities, threats, allies, and competitors may exist in the environment; presents an example scenario of what POST could resemble over the course of the decade ending in 2020; and offers recommendations for attaining a preferred future.

5.Report on SPO C.10.08, Conduct a Comprehensive Review of the Supervisory Course and Curriculum
The mandated 80-hour Supervisory Course was last updated in 2001-2002. At its April 2008 meeting, the Commission approved implementation of Strategic Plan Objective C.10.08, “Conduct a comprehensive review of the Supervisory Course and curriculum.” Primary areas identified for updating included leadership and the series of video vignettes depicting a fictitious team of personnel the new sergeant/supervisor would be expected to supervise. It was also recommended that greater depth of understanding about the situational leadership model be provided.  

New video vignettes focus on leadership development, including contemporary issues such as social media, painkiller addiction, impact of shrinking budgets, rapid technological advances, and diversity in the work force. Course PowerPoints, handouts, group exercises, and individual assignments have been revised. POST web designers created a Supervisory Course Network to enable instructors throughout the state to share innovative ideas, videos, materials, and student exercises. Situational Leadership II® concepts, which provide a more accurate representation of the manner in which the majority of individuals and teams progress and develop in today’s workforce, have been interwoven throughout the course.

The Commission approved the updated course content at its February 2012 meeting. Numerous workshops have been conducted to familiarize the cadre of Supervisory Course facilitators with the updated curriculum and materials.

In approving the consent calendar, the Commission adopts the staff recommendations to delete Strategic Plan Objective C.10.08 as completed.  
6.Report on SPO A.08.08, Expand Entry-Level Cognitive Testing for Peace Officers
This is a report on efforts to update and expand the POST Entry-Level Law Enforcement Test Battery (PELLETB). In April 2012, the final phase of the longitudinal study concluded its determination of adding a new sub-test to the PELLETB and possibly removing the CLOZE sub-test. Results from the study suggest that POST should discontinue the CLOZE sub-test and incorporate measures of fluid reasoning abilities into the PELLETB. Further, findings show that the removal of the CLOZE test and addition of the fluid reasoning measures will add significant value in predicting success in the academy.

7.Report on the Learning Domain 18 Investigative Report Writing Project
This is a report on the status of the Investigative Report Writing project. Effective July 1, 2012, the Training and Testing Specifications were revised to require that the newly developed and validated Learning Domain (LD) 18 Investigative Report Writing test form will be used by Regular Basic Course presenters when evaluating students’ performance. Report writing subject matter experts met and have developed scripts/scenarios on various topics. To ensure the content, validity and integrity of the training videos, these scripts will be reviewed by subject matter experts in the areas Laws of Arrest, Search and Seizures, Use of Force, Vehicle Pullovers, and Domestic Violence.

8.Report on SPO B.15.10, Regarding the Development of a Quality Assessment Process for POST-Certified Courses
Strategic Plan Objective B.15.10 directs staff to develop methods to “ Effectively assess the quality of courses and instructors. ” Since January 2011, POST staff and subject matter experts have met to formulate evaluation instruments and methodologies, conduct pilot tests of the evaluation processes, perform data analysis to inform of  revisions. New course and instructor evaluation rubrics have been developed to assess instructor performance and the quality of POST-certified courses. A new Course/Instructor Evaluator training course has been piloted to train managers and evaluators in the use of the forms. The evaluation process and forms are being field tested in training courses throughout the State. A recurring contract is in place to provide regular opportunities for trained evaluators to review and evaluate POST-certified courses utilizing the new evaluation procedures.

It is anticipated this Strategic Plan Objective will be completed and the Quality Assessment program will be ready for implementation in June 2012. This system of instructor and course evaluation completes Strategic Plan Objective B.15.10. Staff will recommend this item for deletion at the October Commission Meeting.

The Cal EPA is required by statute to transfer funds to POST for the purpose of advancing environmental enforcement training. Over the last several years, POST has utilized these funds to develop an environmental crimes course for the Learning Portal, a telecourse, and a classroom-based course.  

Staff is currently working in partnership with staff from Cal EPA to develop a symposium on environmental crimes training, to be held in San Diego, October 16 – 18, 2012. Two planning sessions have been held consisting of environmental crimes prosecutors, investigators, and regulators to focus on symposium design and curriculum. Staff has contracted with the San Diego Regional Training Center (SDRTC) to present the symposium. The theme of the symposium will be “Collaboration, Partnership, and Integration in Environmental Crimes Enforcement.”

10.Report on SAFE Driving Campaign
The SAFE Driving Campaign met May 1 – 2, 2012, in San Diego with the Vehicle Operations and Training Advisory Council (VOTAC), Advisory Board, and Research Team. Approximately 50 individuals from throughout California and the United States discussed various aspects of Situation-Appropriate, Focused, and Educated (SAFE) driving campaign for law enforcement officers. The next meeting will occure in November 2012.

Since the last report to the Commission, POST staff launched the SAFE Driving News Alert which has nearly 2,000 subscribers. This News Alert is specific to the SAFE Driving Campaign and provides recipients with links to training materials, news articles, research studies, videos, and other information. A Motorcycle Subcommittee has been added to the VOTAC. Its focus is the advancement of best policy and training practices for law enforcement motors.

11.Report on POST Developed Training for Peace Officers on Post-Traumatic Stress Disorder
In September 2010, SB 1296 (Correa) was signed into law, adding Penal Code Section 13515.36, which requires POST to create a training course for peace officers on how to recognize and interact with persons suffering from Post-Traumatic Stress Disorder (PTSD) and Traumatic Brain Injury (TBI) .  POST formed a workgroup comprised of subject matter experts that include the California Department of Veterans Affairs, the U.S. Veterans Administration, UC San Francisco General Hospital Department of Neurology, and appropriate community, local, and state organizations and peace officers with expertise in the area of PTSD and TBI.

Beginning in June 2011, the workgroup met to review existing training that incorporates these topics in the curriculum, including Crisis Intervention Training (CIT). Based on the review, workgroup members determined a training need exists and began development of a course outline. The project transitioned to development of a DVD course to facilitate widespread distribution to California law enforcement agencies. As required by the penal code, the DVD and a report on statewide training will be submitted to the Legislature no later than June 30, 2012.

12.Report on the Model Respiratory Protection Program for Law Enforcement
At the February 2012 Commission meeting staff presented a report on the Model Respiratory Program for Law Enforcement developed in 2004 to address issues surrounding Cal OSHA and enforcement of CCR Title 8 – Section 5144. The 2004 guidelines needed of updating to provide agencies guidance about assessing respiratory protection masks that were issued to their employees.

POST staff has held two meetings with Cal OSHA staff enlisting support for updates to the  guidelines. It will take time and resources to accomplish all of the tasks involved in updating the guidelines and providing a sample policy that complies with Cal OHSA requirements and regulations.

POST staff and Cal OSHA representatives will meet with stakeholders in July 2012 to begin the revisions that will provide guidance to POST agencies statewide.  The guidelines will be ready for Commission review at the October 2012 meeting.

13.Report on the SAFE Driving Symposium
The SAFE Driving Campaign is aimed at reducing fatal and serious injury law enforcement traffic collisions. SAFE stands for Situation-Appropriate, Focused, and Educated driving. “Situation-Appropriate” recognizes the need for officers to modify their driving for varied situations and for trainers, supervisors, and chiefs or sheriffs to establish and reinforce what is appropriate for their agency. “Focused” addresses the many concerns related to roadway position, distraction, fatigue, and multi-tasking. “Educated” refers to both training and policy, and the need for officers to apply what they learn from these areas to their driving.  
 
POST has been holding meetings with stakeholders since 2009 to share information and explore ways to reduce officer traffic-related fatalities and serious injuries. These meetings with the Vehicle Operations and Training Advisory Council, the Research Team, and the Advisory Board have made significant progress and now staff is preparing to present the work of this collective group to constituents in the form of a training symposium.  The symposium will take place October 9 - 11, 2012 in San Diego.

14.Report on the Crowd Management Summit
POST hosted the 2012 Crowd Management Summit in San Diego March 20 - 22, 2012.  Over 350 law enforcement professionals attended the summit. A series of panels presented different views of crowd management. The panels consisted of law enforcement chief executives, city managers/elected officials, experts in technology, and attorneys discussing legal issues and updates on mutual aid processes and procedures.

The summit included a presentation on the updated POST Crowd Management and Civil Disobedience Guidelines.  Staff solicited input on what should be the next step for POST on the issue.  That data is now being analyzed by POST staff.

15.Report on Academic Summit to Bridge Law Enforcement-Community Stakeholders Understanding of Protests and Demonstrations
As a result of the recent Crowd Management Summit, the Executive Director identified a gap in understanding between law enforcement personnel and community stakeholders involved in various protests and demonstrations reviewed at the Summit. Through discussions with academic researchers and POST stakeholders, a concept was developed for a second summit facilitated by academic experts that would focus on enhancing common understandings across law enforcement and community stakeholder groups. The intended outcome would be an incubator-style change process wherein key representatives would benefit from productive dialogue that would spread and support improved relations in future interactions between law enforcement personnel and groups involved in First Amendment activities.

A working group comprised of POST staff; California State University, Sacramento (CSUS) Associate Professor Kevin Wehr; Washington State University, Spokane Professor Bryan Vila; and Defense Advanced Research Projects Agency (DARPA) Program Manager Dr. Brian Lande has been assembled. The summit is tentatively planned for Spring 2013. The Summit is envisioned to be a CSUS event in conjunction with and sponsored by POST.

16.Report on Courses Displaced by the Closure of the Department of Justice Advanced Training Center
Prior to the closure of the Department of Justice (DOJ), Advanced Training Center (ATC) on March 1, 2012, POST staff conducted a review of all ATC certified courses to determine if alternative presenters should be identified. The audit disclosed that many of the ATC courses have not been presented for at least four years and/or there are other certified presenters for many of these courses.

The DOJ requested that POST continue funding presentations of eight of their existing courses through a continuing contract. On February 23, 2012, the Commission approved a $554,784 contract for FY 2012-13 with DOJ to present eight POST-certified courses.

Starting in FY 2012-13, POST will deliver, as part of the ICI program, three other courses currently certified to DOJ.

17.Report on SPO B.16.12, Develop an Interactive, Multimedia Version of the POST Student Workbooks
This report recommends POST develop an interactive, multimedia version of the POST Student Workbooks as a Strategic Plan Objective (SPO).  The new format would provide for more learning modalities, accelerate distribution of content updates, and realize cost savings for cadets. Staff will develop two Learning Domains as a pilot of this new format to test the effectiveness of multimedia based Student Workbook. If the pilot is successful, the full set of Workbooks will be developed in this new format upon Commission approval.

Staff recommends that the Commission add SPO B.16.12 to the Strategic Plan.

As part of an ongoing review of Peace Officer Basic Course content, POST staff and curriculum consultants (academy instructors and other subject matter experts) thoroughly review Learning Domain (LD) content to determine if revisions are necessary. The Training and Testing Specifications and supporting materials for the Learning Domains have been updated to reflect emerging training needs, compliance with legislatively mandated subject matter, changes in the law, or to improve student learning and evaluation. 

The proposed changes affect the following Learning Domains:

  • Minimum Content and Hourly Requirements - Requalification Course

C.Report on Proposed Changes to the Aviation Security Course

In April 2011, Basic Training Bureau (BTB) staff met with Subject Matter Experts (SMEs) to review the 40-hour Aviation Security Course. Airport peace officers employed with agencies participating in the POST program are required to complete the course within 90 days of  employment (Penal Code 832.1).

 

BTB staff and SMEs are proposing changes/updates to the Minimum Standards for Legislatively Mandated Courses (Regulation 1081(a)). All nine blocks of instruction have been revised to better reflect the current needs and trends of aviation security. Seven of nine blocks were re-titled.

D.Report on Proposed Changes to the Field Training Officer Course

In February and June, 2011, Basic Training Bureau (BTB) staff met with Subject Matter Experts (SMEs) to review the 40-hour Field Training Officer (FTO) Course. FTOs of agencies participating in the POST program are required to take the course every three years.

 

BTB staff and SMEs added a block of instruction focusing on how a FTO should evaluate, train, and monitor the trainee in the safe operation of a law enforcement vehicle in both general patrol and emergency situations. Tactical seatbelt removal, the need for ongoing training, and Situation-Appropriate, Focused, Educated (SAFE) driving were also addressed, as directed by the Commission at its October 2008 meeting. The new material was incorporated into the topical area of “Driver Safety,” which was added to the course content listed in POST Procedure D-13-4.

E.Report on Augmentation of FY 2011-12 Contract for the Sherman Block Supervisory Leadership Institute

The Sherman Block Supervisory Leadership Institute (SBSLI) was presented initially in 1988, and its popularity as a value-laden program for enhancing leadership has steady grown. The program’s popularity has necessitated placement of candidates on a lengthy waiting list, in some cases requiring them to wait as long as 18 months to gain entry into a class.

 

A two-pronged effort is proposed to expedite the admittance of applicants into the SBSLI and also reduce, or eliminate altogether, the waiting list. The first action is to increase the class size, from the current number of 24 students to 26. The second action is to add three additional classes to the FY 2011-12 schedule. This augmentation will require funding in the amount of $279,976, which entails increasing the current contract amount from $2,043,357 to $2,323,333. This increase in funding will be only for FY 2011-12. The expanded class size will continue.

F.Report on SPO C.14.11, Request to Contract for Development and Implementation of a Computer Based Testing System to Replace TMAS
The Testing Management and Assessment System (TMAS) was developed eight years ago by a vendor following a competitive bid process. The system uses Internet-based technology to deliver POST tests to proctored testing locations throughout California.  TMAS has been updated to address some functional and usability issues.  However, the system’s security model has not changed since implementation.  The TMAS system was not designed to address newer and more common technical threats, or to accommodate new security technologies as they are developed.  These factors have increased the risk of compromised tests.

 

In June 2010, the Commission directed staff to contract for the completion of an Information Technology Feasibility Study Report (IT FSR) and Information Technology Procurement Plan (ITPP) to replace TMAS with a modern, enhanced testing system. The resulting FSR was approved by the Department of Finance on December 21, 2011. The ITPP was submitted to the Department of General Services on April 24, 2012.

 

Staff has performed significant market research on configurable off-the-shelf (COTS) computer-based testing software, and concluded that modern offerings provide much-improved security features and ease of set-up and use.  If this item is approved, a competitive bidding process based on comprehensive POST requirements will be initiated to select the product that best fits POST’s needs.

G.Report on Request to Contract for Learning Portal Hosting, Support, and Maintenance Services
POST contracts with a private vendor to provide the operational services that support the Learning Portal. This includes hosting of courses, tools and training videos, updating code to support additional browsers, and addressing technical and usability issues. The contract also allows for periodic enhancements to the Portal’s functionality as well as updates of the user interface for better usability.   
 
The current contract expires December 31, 2012. This is a request to pursue a new contract to continue these services.

At the June 2010 meeting the Commission authorized a contract with a governmental agency for a management fellow to fill the training video program coordinator position.   

 

This management fellow is currently directing the program through an extensive transition and redesign of the training video product in response to a field survey and bureau analysis. The extension of the management fellow will ensure consistency as the project is being prepared for release to the field.

In FY 2009-10 the Commission authorized the Executive Director to enter into a contract to develop two online courses that meet legislative or regulatory mandates for an amount not to exceed $500,000. 
 
POST entered into a contract with Allen Interaction, Inc. and began development in May, 2010. Progress on the development was delayed significantly due to the late State budget approval for FY 2010-11, and the vendor’s unexpected restructuring of their development team.
 
The funding has passed the three-year deadline to be expended. The original funds have reverted and the current contract cannot be extended.
 
This is a request is for approval to pursue a new contract to complete the two courses.

MANAGEMENT COUNSELING SERVICES BUREAU
J.Report on Request to Contract with Management Consultants
The Management Counseling Services Bureau (MCSB) is responsible for conducting management studies for law enforcement agencies.  Penal Code section 13513 assigns this responsibility to POST.
 
MCSB has been understaffed for the past 3 years.  Primarily, the under staffing came about because of the hiring freeze imposed on state agencies.  For a period of time, MCSB only had one assigned consultant.
 
As a result, MCSB has amassed a large backlog of management studies and the bureau requires additional staff to meet the legislative mandate.  MCSB is requesting the Commission to authorize funding, to allow staff to contract with management consultants to eliminate the existing backlog of studies.

K.Report on Request to Contract for Web Based Computer Services for Management Studies
The Management Counseling Services Bureau (MCSB) is responsible for conducting management studies pursuant to Section 13513 of the California Penal Code. A major component of these studies is “Patrol Workload Study.” These studies require a computer workload program. The program MCSB currently uses is an obsolete “DOS” based software program, which no longer meets the requirements or needs of MCSB.
 
MCSB must contract for a new computer service to better address the needs of the law enforcement community and meet the mandates set forth in Penal Code section 13513. MCSB proposes to contract with Corona Solutions or another qualified vendor for a web based computer service that meets all of the requirements to complete a professional and accurate patrol workload study.

L.Report On Augmentation of FY 2011-12 Contract for the Entry-Level Dispatcher Selection Test Battery
The Commission previously authorized that the mandated Entry-Level Dispatcher Selection Test Battery be made available to agencies in the POST program at no cost. Due to limited staff and equipment resources it is necessary to contract with an outside vendor for this service. Cooperative Personnel Services has administered the POST Entry-Level Dispatcher Test Battery in an efficient and timely manner during the last eight fiscal years. The current FY 2011-12 contract was initially approved for $116,474.51; however, as test administrations have increased over the past few months, the original amount needs to be augmented. The new amount, not to exceed $174,750.00 remains an overall cost savings and will allow POST to continue to provide this service to the field.

In March, 2012, the California Department Of Justice (DOJ) Advanced Training Center, was closed and most POST contract training courses were eliminated. It was decided that the most appropriate program to incorporate the Narcotics and Officer-Involved Shooting Investigations Training courses was the ICI program. Each of these courses have been presented by DOJ to investigators for more than 20 years, and, as evidenced by attendance rates, continue to remain in high demand.

 

Staff contacted existing and potential new ICI presenters across the state to identify interested entities, and then determine those most capable of providing intensive, scenario-based training. Staff met with San Diego Regional Public Safety Training Institute (SDRPSTI) to assess this possibility and ensure understanding of the strict ICI requirements. SDRPSTI is a POST-certified presenter and has agreed to accept the responsibilities required to deliver ICI training, to include:  five offerings of Narcotic Investigations and three offerings of Officer-Involved Shooting Investigations courses. The source of funding for these courses is redirected from the unused allocation for the presentation of former DOJ contract courses. Staff recommends certifying these presentations to SDRPSTI.

  • State Center Regional Training Facility, Fresno – five offerings of the ICI Narcotic Investigations Course;

 

  • South Bay Regional Public Safety Training Consortium – three offerings of Officer-Involved Shooting Investigations courses; one additional course offering for the Sexual Assault and Financial Crimes courses, and two additional ICI Homicide course offerings. Also, the Financial Crimes course requires increased funding to provide students with critical training tools. 

 

The request for the increase in existing ICI courses is due to the high demand and year long waiting lists to meet this training need. The source of funding for these courses is from a portion of the existing, unused allocation for the presentation of courses formerly supported through the contract with DOJ. Staff recommends increasing presentations as outlined above.

POST has developed training and selection standards to enhance the professionalism of public safety dispatchers for more than 25-years. POST has expanded its commitment to meeting the needs of public safety dispatchers and raising the bar, through creation of the Public Safety Dispatcher Advisory Council (PSDAC), addition of a PSDAC representative to the Instructor Standards Advisory Council (ISAC) and addition of a PSDAC representative to the Commission’s Advisory Committee. 

Over the past 18 months, POST, in conjunction with its public safety dispatcher stakeholders and advisory groups, has focused on expanding in-service training and development opportunities for public safety dispatchers. This has been accomplished through the creation of a Public Safety Dispatcher Program within the Training Program Services Bureau that was staffed by a retired annuitant. Primary activities included expansion of the Instructor Development Institute to include dispatcher-specific offerings (approved by the Commission in February 2012) and development of pilot courses such as "The Public Safety Dispatcher’s Role in Officer Safety" and "Handling In-Progress Calls and Active Shooter Incidents". 

Beginning in July there is a need for a skilled public safety dispatcher professional to coordinate the various components to develop a full-service program. Therefore, staff is seeking approval to contract with a public entity to secure a Public Safety Dispatcher Management Fellow initially for one year at a cost not to exceed $140,000.

 

If the Commission concurs, the appropriate action would be a MOTION to authorize the Executive Director to enter into a contract with a public or governmental entity for the services of a Public Safety Dispatcher Management Fellow in an amount not to exceed $140,000. (ROLL CALL VOTE)

P.Report on Request to Accept VAWA Grant Funds and Contract for Presentation of VAWA Courses

In August 1997, the Commission approved acceptance of a Violence Against Women Act (VAWA) law enforcement grant.  Since then, the Commission has continued to accept VAWA grant funds to develop and present training to law enforcement personnel on domestic violence and sexual assault.

 

Staff anticipates receiving $437,660 in VAWA funding for FY 2012-13 from the California Emergency Management Agency (Cal EMA). Since 2005, this grant has required an in-kind and cash match equal to 25% of the total project. For FY 2012-13, POST will be required to provide a match of $145,887, which will be met by equipment purchases and upgrades, curriculum updates, instructor travel, and training reimbursements. This will bring total VAWA program funding to $ 583,547 for FY 2012-13. Staff recommends accepting the VAWA grant funding, providing the in-kind and cash match, and contracting with the San Diego Regional Training Center (SDRTC) or another public or governmental entity in an amount not to exceed $437,660 to facilitate the course presentations and management of the grant program.

COMMISSION APPEAL HEARINGS
Q.Report on Appeal to Commission by International Training Resources (ITR)

On July 21, 2011, Officer Michael Short, Visalia Police Department was injured while attending a POST certified training course at the old Fort Ord military base in Monterey County. The course, Distraction Device Breaching – Instructor (CCN 1025-33566-11-001), was presented by International Training Resources (ITR). The injury sustained by Officer Short occurred when the detonation of a distraction device resulted in him being struck in the head and upper body. He lost one eye and sustained facial injuries.

 

POST conducted an investigation into the incident and concluded that ITR had deviated from the approved course, used instructors not approved by POST, did not have proper licensing for the use of explosives, and failed to follow proper student safety protocols.

 

As a result of the investigation, POST staff notified the presenter of the course that all courses (22 at the time) presented by ITR were decertified; that no training in any of the courses could be started or presented in any manner after 5:00 p.m., October 28, 2011; and that the partners of ITR were prohibited from participating in any POST-certified training course as instructors, coordinators, safety officers, or instructional aides or assistants.

 

Subsequent to the action taken by POST staff, ITR appealed to the POST Executive Director to have the sanctions lifted. The appeal was denied by the Executive Director. This decision resulted in the partners of ITR appealing the decision to the Commission.

 

If the Commission concurs, the appropriate action would be to hear the appeal of International Training Resources and render a decision consistent with the requirements of Commission Regulation 1058.
