ISSUE:
Should the Commission approve the proposed changes to Commission Regulations 1950 and 1953 and the continuation of the Office of Administrative Law (OAL) regulatory review process? 
BACKGROUND:
At the June 23, 2016 meeting, the Commission proposed language to amend the Peace Officer Selection Standards to allow departments the discretion to determine the appropriate assessments for peace officers returning to the same POST-participating department after a voluntary separation of no more than 180 days. The Commission delegated Commissioner Robert Doyle the authority to approve the final language to be submitted to the Office of Administrative Law to begin the regulatory review process. 
ANALYSIS:

Subsequent to the June meeting and with the authority granted by the Commission, language consistent with the Commission’s recommendation was drafted and approved by Commissioner Doyle. The proposed language amending Commission Regulations 1950 and 1953 is attached (see Attachment A).

The proposed language was submitted to the Office of Administrative Law (OAL) on July 26, 2016 to begin the regulatory review process. The Notice was published August 5, 2016 and the requisite 45-day comment period concluded on September 19, 2016. The complete rulemaking file was submitted to OAL on September 20, 2016. OAL has 30 working days to conduct their review.

Due to OAL previously expressing concerns with the Commission’s ability to delegate authority to one Commissioner, staff is submitting this agenda item for Commission approval to allow the proposed language to move forward with the OAL should their concerns result in delay with the current regulatory package submitted.

RECOMMENDATION:
Staff recommends that the Commission approve the proposed changes to Commission Regulations 1950 and 1953 and the continuation of the OAL regulatory review process.
