ISSUE:
Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed revision to Commission Regulation 1052, Requirements for Course Certification?
BACKGROUND:

At the October 26, 2017, Commission meeting, POST staff presented information to the Commission and asked for feedback regarding removal of First Aid/CPR/AED training from the basic courses and replacing hours and content with Procedural Justice, De-escalation, and Rifle training. At the February 8, 2018, Commission meeting, POST staff presented the pilot course proposal for approval, which the Commission granted.

Although POST received Commission approval to remove First Aid/CPR/AED as part of the pilot program, POST staff has put this portion temporarily on hold.

Regulation 1052(g) provides limited information regarding pilot programs, and after reviewing this regulation POST staff determined it does not currently outline the process for implementation, nor does it allow for removal of course content and/or hours in a pilot program. 

At the June 23, 2018, meeting, the Commission authorized POST staff to develop, and submit for public comment, proposed changes to Regulation 1052(g) regarding pilot programs.

ANALYSIS:

The proposed changes would allow POST’s Executive Director to provide initial internal authorization, followed by ultimate review and approval by the Commission, for the initiation of a pilot program to evaluate, and change, current regulations to include the addition and/or elimination of course hours, course content, and course certification requirements. Evaluating, and changing current regulations will include collaboration with Subject Matter Experts (SMEs), law enforcement officials, and community stakeholders to elicit input on course content and/or hours. Final approval of the pilot program will be made by the Commission prior to the start of any pilot program. The proposed changes would be applicable to all POST-certified courses.

POST has started the Office of Administrative Law (OAL) process by publishing the notice for public comment, and if approved by the Commission, the proposed changes will be submitted to OAL for the final review and approval at the conclusion of the public comment period. Should POST receive any comments on the proposed changes that will require additional modification of the language, POST will make the changes and publish a 15-day notice to allow for additional comments. If additional changes are required, outside of those presented in this report, those changes will be presented to the Commission for approval in February 2019.

RECOMMENDATION:
Staff recommends the Commission approve, subject to the Notice of Proposed Regulatory Action Process, the amendments to Regulation 1052 described in this report.
