ISSUE:
Should the Commission authorize the Executive Director to contract with community colleges, law enforcement agencies, or other entities for presentation of the Supervisory Course in FY 2019/20 in an amount not to exceed $299,480? 
BACKGROUND:

The 80-hour POST Supervisory Course is mandated for peace officers promoted, appointed, or transferred to first line supervisory positions.  Other officers may attend the course if they might be promoted as first line supervisors within the next 12 months or are assigned to quasi-supervisory positions.  These officers may attend the course with agency approval provided that each individual officer has been awarded or is eligible to obtain the Basic Certificate.

The presenters of the Supervisory Course are both community colleges and law enforcement agencies.  Community colleges present the course using State full time equivalency (FTE) revenue to support the training.  Law enforcement agency presenters use their staff to instruct and may receive FTE funds through an affiliation with a local community college.  In many cases, FTE funding is insufficient to offset actual presentation costs and expenses.  The Commission has previously authorized subvention of expenses in excess of FTE funds at an actual cost not to exceed $6,930 per presentation.

During FY 18-19, the Supervisory course underwent a course quality evaluation. In addition to the evaluation, outreach to the field for feedback on the quality of the course and instruction will be completed prior to the end of FY 18-19.

There is currently a shortage of instructors based on attrition. Instructor candidates must complete a 40 hour Train the Trainer  Course to qualify to instruct.

During FY 2018 - 19, a total of $221,760 was requested to enable as many as 32 subsidized presentations, in the amount of $6,930 each.  Seven of the total 16 Supervisory Course presenters requested subsidies.   A single presenter was utilizing Plan V Course Certification to receive reimbursement for the course.

ANALYSIS:

During FY 2018-19, approximately 1590 persons may attend the subsidized  and unsubsidized Supervisory Course. With an average class size of 30 students (depending on presenter), 53 presentations of the Supervisory Course may again be required to accommodate the projected number of students statewide. 

The requested contract represents the same amount as the FY 2018-19 contract approved by the Commission in addition to 4 additional sessions provided to the presenter migrating from Plan V reimbursement to contract. The funds will be allocated among presenters in a similar manner as 2018-19. In addition to the presentation costs, funding is requested for (2) train-the- trainer courses to refresh the inventory of instructors. See Attachment A.

The requested contractual arrangement will provide funding to partially offset the presentation costs for the Supervisory Course.  The contract method provides additional controls over the content, instructors, quality of the presentations, and shared costs for delivery of this mandated training.  Presenters entering into a contract are not authorized to use POST funds for expenses that would not be reimbursable by POST (e.g., those associated with enrollment of a student from a non-POST reimbursable agency).  

RECOMMENDATION:
Staff recommends the Commission authorize the Executive Director to enter into contracts with community colleges, law enforcement agencies, or other entities to present the Supervisory Course during FY 2019-20, for a total amount not to exceed $299,480.
