ISSUE:

Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed Training and Testing Specifications for Peace Officer Basic Courses, as specified in this report?

BACKGROUND:

On September 30, 2018, Governor Brown signed into law Assembly Bill 2504, enacting Penal Code section 13519.41 which mandates the commission to develop and implement a course of training regarding sexual orientation and gender identity minority groups in this state; to include specified topics, including the terminology used to identify and describe sexual orientation and gender identity and how to create an inclusive workplace within law enforcement for sexual orientation and gender identity minorities.

ANALYSIS:

AB 2504 added section 13519.41 to the Penal Code, requiring POST to develop and implement a course of training on sexual orientation and gender identity minorities in the Regular Basic Course (RBC).  The new mandate requires the content to include the terminology used to identify and describe sexual orientation and gender identity and how to create an inclusive workplace within law enforcement for sexual orientation and gender identity minorities.

In January 2019, POST convened a 3-day workshop comprised of subject matter experts in law enforcement and the community to develop training content as prescribed by the law. The content developed in the workshop will be added to Learning Domain 42 – Cultural Diversity/Discrimination and in Learning Domain 25 – Domestic Violence. 

The proposed changes (Attachments A and B) affect the following Learning Domains:

  • LD 25, Domestic Violence (Attachment A)
  • LD 42, Cultural Diversity/Discrimination (Attachment B)
RECOMMENDATION:

Staff recommends the Commission approve the revisions to the Training and Testing Specifications as amended, and pursuant to the rule-making process and approval from the Office of Administrative Law. If no one requests a public hearing, the amendments will become effective October 1, 2019.
