ISSUE:

Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the revision to Commission Regulation 1052, Requirements for Course Certification?

BACKGROUND:

Commission Regulation 1052 identifies the minimum qualifications for directors, coordinators, and recruit training officers of the basic courses. 

Currently, the qualifications of directors, coordinators, and recruit training officers are not clearly defined, leaving the interpretation of qualifications up to the presenter's discretion.  This void has led to issues with some presenters, which have had a negative impact on the quality and effectiveness of the program and hinders the success of the students.  Additionally, the director, coordinator, and recruit training officer have independent roles and responsibilities. Some presenters have attempted to combine multiple roles and responsibilities to a single individual.

 

ANALYSIS:

The proposed revision would update Commission Regulation 1052 to include a requirement for basic course directors and coordinators to have sworn full time first-level supervisory law enforcement experience.  Additionally, the proposed revision would require recruit training officers to have sworn full time law enforcement experience. This proposed change to regulation would be effective for any director, coordinator, or recruit training officer appointed on or after April 01, 2020. In addition the proposed changes adds verbiage to clarify that each position is to be held by separate individuals. 

 

RECOMMENDATION:

Staff recommends the Commission approve, subject to the Notice of Proposed Regulatory Process, the recommendations as described in this report. 

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report. If no one requests a public hearing, the changes will become effective April 01, 2020.
