ISSUE:

Should the Commission dissolve, modify the composition, terms of service, and/or duties for the Advisory Committee in order to ensure optimal service to the Commission and its stakeholders, and should the Commission appoint the nominees for the existing Advisory Committee?

 

The appropriate action would be a MOTION to modify the composition, terms of service, and/or duties for the Advisory Committee (with specific direction for staff to implement), or to maintain status quo, as well as a MOTION to approve each individual pending nominee for the existing Advisory Committee?


BACKGROUND:

The Advisory Committee was formed by the Commission in the early 1960’s, and the composition has evolved over the course of almost 50 years. Members of the Advisory Committee represent their respective stakeholder groups, the public, or the community at large. The current composition of the Advisory Committee is as follows.

  • California Academy Directors’ Association (CADA) (Lanny Brown)
  • California Association of Administration of Justice Educators (CAAJE) (Kathy Oborn)
  • California Association of Police Training Officers (CAPTO) (Randy Waltz)
  • California Coalition of Law Enforcement Associations (CCLEA) (Artin Baron /Vice Chair)
  • California Highway Patrol (CHP) (Ryan Okashima)
  • California Peace Officers’ Association (CPOA) (Sandra Spagnoli / Chair)
  • California Police Chiefs’ Association (CPCA) (Greg Garner)
  • California State Sheriffs’ Association (CSSA) (Rick Basilio)
  • Office of the Community College Chancellor (unfilled)
  • Peace Officers’ Research Association of California (PORAC) (Marcelo Blanco)
  • Public Member (Elmo Banning)
  • Public Member (Alex Bernard)
  • Public Safety Dispatcher (Jaime Young)
  • Advisory Council Specialized Law Enforcement (Philip “PJ” Webb)

The following nominations (or re- nominations) are in place for the Commission to consider due to regular term expirations:

  • Appointment of replacement representative to the Advisory Committee.  Letter from Carol Leveroni, California Police Officers Association (CPOA) Executive Director, requesting Chief David Honda, Watsonville Police Department, to the POST Advisory Committee as CPOA's replacement representative for Chief Sandra Spagnoli. 
  • Appointment of representative to the Advisory Committee.  Letter from Ronald A. Lawrence, President California Police Chiefs’ Association (CPCA), requesting Chief Jason Salazar, Visalia Police Department be appointed to the POST Advisory Committee as CPCA's representative.
  • Letter from Damian Sandoval, Director Napa Valley College Criminal Justice Training Center, advising he will replace Lanny Brown as California Academy Directors’ Association (CADA) representative on the POST Advisory Committee whose term expires July 2019.   
  • Letter from Brian Marvel, PORAC President, requesting Officer Marcelo Blanco be reappointed to the POST Advisory Committee as PORAC's representative.  Current term expires September 2019. 
  • Letter from Kevin Mizner, California Association of Police Training Officers (CAPTO), requesting Randy Waltz be re-appointed to the POST Advisory Committee as CAPTO's representative. 
  • Letter stating the Public Safety Dispatch Advisory Council (PSDAC) requests the Commission reappoint Jaime Young as PSDAC representative on the POST Advisory Committee. 
  • Letter from Elmo Banning, Advisory Committee Public Member, seeking reappointment to the Advisory Committee as a Public Member.  Current term expires October 2019.   
  • Letter from Alex Bernard, Advisory Committee Public Member, seeking reappointment to the Advisory Committee as a Public Member.  Current term expires October 2019.
  • Letter stating the California Coalition of Law Enforcement Association (CCLEA) requests the Commission reappoint Artin Baron as CCLEA representative on the POST Advisory Committee.  Current term expires September 2019.

(The prior incumbent of the Community College Chancellors position retired, and POST staff have tabled active solicitation of a new nominee pending a decision by the Commission with respect to the future of the Committee.)

 

The related nomination letters and/or correspondence for these individuals is located in this section as Attachment A as well as the New Business section of the Commission Agenda for commissioner review.


ANALYSIS:

The purpose of the Advisory Committee is to provide a connection between the Commission and organizations and individuals that share an interest in the Commission’s work.  The committee meets prior to each tri-annual Commission meeting to review and analyze topics the Commission will later address. 

To effect that process, POST staff prepare an agenda for each meeting to address the business of the Commission, which is published 15 days prior to the meeting.  Upon receipt, Advisory Members are to review in advance items that will be considered by the Commission.  Members make recommendations and advise the Commission via the Committee Chair, through discussion of agenda items prepared by POST staff. And, Advisory members are asked to present any reports from their respective constituencies that may assist the Commission. Some members regularly present such reports, while others do so with less frequency.

In order to ensure the Commission is best served by the Advisory Committee, POST staff are requesting direction and guidance with respect to the future direction of the Committee, and to make sure the return on investment best serves the Commission’s needs.

Potential considerations the Commission may entertain regarding the Advisory Committee may include, but not be limited to:

  • Take no action, and leave the Advisory Committee procedures in place
  • Modify the composition of the members
  • Reduce or expand the number of members
  • Implement specific limits on member terms to encourage fresh perspective
  • Specify member reporting goals
  • Eliminate the Advisory Committee
  • Create a different Committee

This matter was addressed at the October 18, 2018, February 21, 2019, and May 30, 2019 Commission Meetings. When the matter was presented, POST made a recommendation for the Commission to consider a revision of the Committee makeup to reflect the following representation:

  • California State Sheriffs’ Association (CSSA)
  • California Police Chiefs’ Association (CPCA)
  •  Peace Officers’ Research Association of California (PORAC)
  • California Peace Officers’ Association (CPOA)
  •  California Highway Patrol (CHP)
  • Five (5) currently employed CA peace officers at or below the rank of sergeant
  • California Academy Directors’ Association (CADA)

Since the original presentation, it should be noted that the composition has already changed significantly, with new members joining the Committee through the regular term cycles and /or retirements. 

And, at the February 2019 Commission Meeting the delegated Sub-Committee recommended retaining the current composition, adding additional Advisory members, and for POST staff to provide Agenda Items earlier for the Committee to take into consideration.  POST Staff expressed concern over the last recommendation, as it creates a significant administrative hardship due to the mandates of Bagley-Keene rules with respect to public notification and publication of Agenda Items.

RECOMMENDATION:

Staff recommends that the Commission provide direction and guidance with respect to the future direction of the Advisory Committee.

 

Should the Commission elect to make changes, POST staff recommends the Commission initiate a MOTION to modify the composition, terms of service, and/or duties for the Advisory Committee (with specific direction for staff to implement).

 

Further, should the Commission elect to maintain the current Committee composition, POST staff recommends a MOTION to approve each individual pending nominee for the existing Advisory Committee?
