ISSUE:

Should the Commission approve changes to Regulation 1052 Requirements for Course Certification clarification on when a course budget is required?

BACKGROUND:

Regulation 1052 Requirements for Course Certification language lacks specificity with respect to when a presenter must submit a course budget.

 

The Notice of Proposed Regulatory Action procedures has already started. The 45-day public comment period will conclude on October 21, 2019. If no comments are received, the proposed changes to Regulation 1052 will be submitted through Office Administrative Law (OAL) if authorized by the Commission. 

ANALYSIS:

The proposed amendment (see Attachment A) would allow POST to hold course presenters accountable when a training course and/or student is significantly funded by POST.  It also allows POST to review the course budget to ensure appropriate tuition cost to POST agencies when a presenter requests student tuition above $125 per day of instruction.

RECOMMENDATION:

Staff recommends the Commission approve proposed changes to amend Regulation 1052, Requirements for Course Certification, to clarify when a course budget is required.

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report.
