ISSUE:
Should the Commission approve the staff recommendation to provide clean-up language to properly reference applicable Regulation?
BACKGROUND:

Regulation 1055 (h) refers to a requirement to retain a copy of documents that must be kept on file at a presenter's facility, pursuant to Regulation 1053 (a) and (b). However, 1053 (a) and (b) refers to Self-Paced Training process and certification criteria.

The correct reference should be Regulation 1052.

Current language:

"(h) Retention of Certification Documents
For any POST-certified course, a current copy of the documents required by Regulation 1053 (a) and (b) must be kept on file at the presenter's facility for inspection by POST."

Proposed language:

(h) Retention of Certification Documents
For any POST-certified course, a current copy of the documents required by Regulation 1052 (b) must be kept on file at the presenter's facility for inspection by POST.

 

 
ANALYSIS:

When POST staff contact presenters regarding course certification, staff will frequently refer to Regulation 1052 - Requirements for Course Certification. This Regulation lists all of the procedural and document processes to obtain POST certification.

Staff will also refer to Regulation 1055 - Requirements for Course Presentation. This Regulation describes the processes involved with course presentation. When speaking to presenters about the requirement for document retention, they constantly need to make a manual correction to Regulation 1055 (h), which incorrectly references Regulation 1053.

The correction in Regulation  1055 would eliminate the need to perform manual corrections and provide accurate information to presenters and POST staff.
RECOMMENDATION:
If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report.
