ISSUE:

Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed changes to Commission Regulation 1005?

BACKGROUND:

A Basic Course Waiver (BCW) provides an exemption from the Regular Basic Course (RBC) or Specialized Investigator Basic Course (SIBC) training requirements to individuals from another state, with no prior California law enforcement training or experience.

Current Regulation does not allow for California basic course graduates, who have had out of state qualifying employment to participate in the waiver process and attend the Requalification Course.  

The purpose of BCW is to provide an alternative to attending the Basic Course, either the RBC or SIBC. Currently there are two methods in which this can be obtained.  Attendance and successful completion of a POST-certified Requalification Course or the successful completion of the Basic Course Waiver (BCW) Testing Process.  

The POST-certified Requalification Course serves to refresh a peace officer's ability to perform critical manipulative skills and provide updated instruction for those portions of the Basic Course that have changed, including legislative mandates and areas involving safety or potential liability.

ANALYSIS:

The proposed revision to Commission Regulation 1005 would allow individuals who have completed the RBC or SIBC in California, with qualifying out of state or federal law enforcement experience, and more than six years has elapsed since completion of  the RBC or SIBC, to participate in the Basic Course Waiver process. 

The proposed revisions would also require all Basic Course Waiver applicants to participate in the Requalification Course unless entering California Law Enforcement at middle management or executive rank. This would align the waiver requirements with the current regulation requirement for individuals with California training and experience.

The requalification course consists of an overview of basic course content along with updated instruction on California laws.  It is necessary to ensure that individuals are competent and proficient prior to appointment. This would increase the applicants' chance for success in the field training program and successful completion of a probationary period.  

RECOMMENDATION:

Staff recommends the Commission approve, subject to the Notice of Proposed Regulatory Process, the recommendations as described in this report. 

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report. If no one requests a public hearing, the changes will become effective January 1, 2020.
