ISSUE:

AB 392 was signed by the Governor on August 19, 2019, and goes into effect January 1, 2020.

BACKGROUND:

AB 392 redefines the circumstances under which a homicide by a peace officer is deemed justifiable

Additionally, AB 392 affirmatively prescribes the circumstances under which a peace officer is authorized to use deadly force to effect an arrest, to prevent escape, or to overcome resistance.

Therefore, California peace officers must be provided with training on the new law in order to be better equipped to serve their communities. 

POST has taken robust proactive steps to address this matter. 

ANALYSIS:

POST has developed a 2-hour course of instruction to be available for agencies to utilize in providing personnel with update training related to uses of force per AB 392. The structure of this course follows the language stipulated in AB 392 with regard to redefining the circumstances under which a homicide by a peace officer is deemed justifiable, as well as affirmatively prescribing the circumstances under which a peace officer is authorized to use deadly force.

This course is designed to provide an overview of the amended language of AB 392 and facilitate dialogue about its impact on agencies' policies and practices regarding uses of force, and an evaluation of the officers' decisions to use force.

This course will be made available in conjunction with an informational video that will be produced the by Learning Technology Resources and made available on the POST Learning Portal.
