ISSUE:
Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the revision to Commission Regulation 1005, Minimum Standards for Training?
BACKGROUND:

Commission Regulation 1005, Minimum Standards for Training requires every full-time peace officer promoted, appointed, or transferred to a first-level supervisory position shall complete a certified Supervisory course. Commission Regulation 1005 also requires every full-time peace officer promoted, appointed, or transferred to a middle-management position shall complete a certified Management course.

ANALYSIS:

The current regulation does not specifically state the required Supervisory course and Management course needs to be “POST certified," which does not match the intent of the regulation. Non-specificity of POST certification risks regulation interpretation for peace officers to attend a course with content not satisfied by POST requirements.

The proposed changes to Commission Regulation 1005 (See Attachment A) would clarify the Supervisory and Management course must be “POST certified." Currently, every department participating in the POST reimbursement program is eligible for reimbursement for attending the Supervisory and Management courses.
RECOMMENDATION:
POST staff recommends that, subject to the Notice of Proposed Regulatory Actions, the Commission approve the amendments to Regulation 1005 as described in this report.
