ISSUE:
Should the Commission approve, the proposed changes to Regulation 1005 (b) and (c) to clarify timelines for attendance at Supervisory and Management Courses through the Notice of Proposed Regulatory Action process?
BACKGROUND:

Regulation 1005 (b) and (c) (i.e., Supervisory Course (Required) and Management Course (Required)) was enacted with the intent that peace officers who were to be, or had been, promoted to supervisor or manager had a 24 month window to attend the Supervisory or Management Course. This 24 month window was to incorporate either the 12 months proceeding, or 12 months following, the promotion/appointment.

The regulation was written in such a manner that the entire regulation sections(s) had to be read in order to infer the 24 month period. The wording was confusing, and, over time, agency personnel were reading and interpreting only the first sentence of the regulation sections(s), which stated that peace officers being promoted to supervisor or manager complete the required respective course “prior to promotion or within 12 months after the initial promotion…” As such, the regulation sections have been misconstrued causing some agency training personnel to believe that peace officers may attend the supervisor or management course at any time prior to the promotion, or within 12 months after it. The result of the misinterpretation is that some agencies are sending peace officer promotional candidates to the courses several years prior to the officers actually being promoted.

ANALYSIS:

The proposed changes to Commission Regulation 1005 (b) and (c) (see Attachment A) will clarify the language related to the timelines for attending the Supervisory and Management courses, making the original intent of the regulation timelines more easily understood and reducing future misinterpretations.  These proposed changes will also ensure that the required supervisorial and managerial training is contemporaneous to the officers' promotions.

With a more timely delivery of information, adult learning concepts can be maximized,  and the promoted officer will have an increased opportunity to realize the nexus between the training concepts and the actual assignment, better preparing him/her to put the training concepts into action. Peace officers promoted well after taking such training may not have the opportunity to incorporate the training into their daily activities due to lack of immediate exposure to experiences and situations where the training concepts can be of use. Timely delivery of course information can better enhance an officer’s transition to supervisor or manager. 

RECOMMENDATION:
Staff recommends that the Commission approve amendments to Commission Regulation 1005 as described in this report, subject to the Notice of Proposed Regulatory Actions.  If the Commission concurs, the changes will become effective July 1, 2018.
