ISSUE:
Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed changes to Commission Regulations 1005, 1007, 1008, 1052, and the Basic Courses Test Management and Security Protocols 2017?
BACKGROUND:

POST is aware the use of body-worn cameras in the training environment is becoming more prevalent for the purpose of acclimating students to their use and functions. A number of basic course presenters already have, or are preparing to have, all students and, in some cases, staff members wear body-worn cameras throughout each training day.

While POST does not object to the use of body-worn cameras in the training environment, at times training days do include the administration of confidential POST-developed test materials. In order to assist basic course presenters in both maintaining the confidentiality of POST-developed test materials during the presentation of the basic courses and providing information to their agency or the agencies who send students through their courses, changes have been proposed to clarify the following:

  • Body-worn cameras that are capable of recording must be removed prior to certain test sessions.
  • Body-worn camera manufacturers or distributors as well as their employees with administrative rights/access to stored content shall not have access to confidential POST-developed test material.
  • Documentation requirements for individuals permitted access to a test session recording.   POST allows only the presenter to record a scenario test session under certain circumstances.
  • Additional changes were made in order to clarify current language and assist basic course presenters.
ANALYSIS:

The proposed changes to Commission Regulations are in response to training trends that are continually evolving with a focus on ensuring the continued confidentiality of POST-developed test material.

The following regulations are affected:

  • 1005. Minimum Standards for Training
  • 1007. Reserve Officer Minimum Training Standards
  • 1008. Basic Course Waiver and Requalification Requirement
  • 1052. Requirements for Course Certification Basic Courses Test Management and Security Protocols 2017 (incorporated by reference)

The recommended changes were presented to, and reviewed by, the Consortium of Academy Directors.

RECOMMENDATION:
Staff recommends the Commission amend the POST Administrative Manual, section B, and the POST Basic Courses Test Management and Security Protocols 2017, pursuant to the rulemaking process and the Office of Administrative Law.  If no public comment is requested, the changes will become effective on April 1, 2018.
