ISSUE:
Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed changes to Commission Regulation 1953? 
BACKGROUND:
Interim police chiefs inherently have limited terms with hiring departments. Current regulation requires a complete background investigation each time the chief is appointed to a new department, regardless of when the previous background was completed. 
ANALYSIS:

Commission Regulation 1953 is being revised to provide a more streamlined process for the hiring of these limited term, interim chiefs. The proposed regulation would allow for the hiring authority to perform a complete background or an updated background, at their discretion, based on the interim chief having undergone a complete background investigation within a certain period of time. The proposed changes are provided as Attachment A.

Specific revisions include:

Commission Regulation 1953: Peace Officer Background Investigation is being modified to provide the hiring authority with the discretion to conduct a full or updated background investigation on an interim police chief who has undergone a complete background investigation within the past five years and has been employed as an interim chief within the past 24 months with a POST participating department. 

RECOMMENDATION:
Staff recommends that the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed changes to Commission Regulation 1953.
