ISSUE:
Should the Commission approve, pursuant to the rulemaking process and the Office of Administrative Law, the proposed amendments to Commission Regulation 1052, Requirements for Course Certification?
BACKGROUND:
At the October 18, 2018 meeting, the Commission approved proposed changes to Regulation 1052(g) regarding pilot presentations and authorized POST staff to submit the changes to the Office of Administrative Law (OAL). When reviewing the proposed changes, OAL determined additional clarification was necessary to ensure the process steps for approval and implementation were clear.
ANALYSIS:

The proposed changes previously approved by the Commission are included and indicated in single strikethrough/single underline text. The proposed changes that require approval of the Commission are indicated in double strikethrough/double underline highlighted text to ease the review process. The reasons for the newly proposed changes are as follows:

  • Changed all “pilot program” references to “pilot presentation” for consistency with existing language.
  • Added “amended” before “curriculum” for consistency with existing language.
  • Modified the referenced Regulation sections to reflect only those sections that include requirements impacting certification of a pilot presentation.
  • Clarified the process has been established for both the approval and implementation of a pilot presentation.
  • Reversed the order of process steps 2 and 3. Determining the need for a pilot presentation should come before approval by the Executive Director and Commission.
  • Moved “meets stakeholder needs” from the step 2 introductory sentence to factor A.
  • Reworded step 3 (now step 2) for clarity purposes.
  • Added factors to step 2 in order to clarify what POST will be looking at when determining whether or not to move forward with a pilot presentation.
  • Reworded step 4 for clarity purposes.
  • Removed from step 4 the portion of the sentence stating: “will apply to all individuals attending the pilot course.”.This language currently exists in the Regulation.
  • Clarified what the term requirements means in step 5.
RECOMMENDATION:
Staff recommends the Commission approve, pursuant to the rulemaking process and the Office of Administrative Law, the amendments to Regulation 1052 described in this report.
