ISSUE:

Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed revision to Regulation 1005 and the creation of the Specialized Investigators' Basic Course Waiver form, as enumerated in the report?

BACKGROUND:

A Basic Course Waiver (BCW) provides an exemption from the Regular Basic Course (RBC) or Specialized Investigator Basic Course (SIBC) training requirements. A BCW is granted to individuals with qualifying out of state or federal law enforcement experience, whose law enforcement training, experience and education are deemed by POST to demonstrate sufficient law enforcement knowledge, skill and proficiency. The prescribed course of training appropriate to the individual's appointment is determined by the Commission and is specified in sections 1005(a) or 1007(a). After successful completion of the process, the appropriate waiver is issued.

ANALYSIS:

The current Basic Course Waiver form (POST 2-267) has been used for both Regular Basic Course Waiver (RBCW) applicants and Specialized Investigators’ Basic Course Waiver (SIBCW) applicants. The minimum qualifications for the Specialized Investigator Basic Course Waiver process is not identified on the current Basic Course Waiver form.

The proposed revisions to Regulation 1005 (Attachment A) add the new Specialized Investigator Basic Course Waiver form (POST 2-353).  The new form was created with the minimum qualifications for SIBCW applicants (Attachment B).  The current form (POST 2-267) has been updated to reflect the change (Attachment C)

RECOMMENDATION:

Staff recommends the revisions to Regulation 1005 and the Basic Course Waiver Applications be amended pursuant to the rulemaking process and the Office of Administrative Law.  If no one requests a public hearing, the amendments would become effective October 1, 2021.
