ISSUE:

Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed Training and Testing Specifications for Peace Officer Basic Courses, as enumerated in this report?

BACKGROUND:

As part of an ongoing process, staff reviews regulations and procedures related to courses to determine if revisions are necessary. The outcome includes recommendations for updating and enhancing POST-certified courses. 

Due to recent events, peace officers need to be aware of the potential risks when trying to restrain a subject to include body positioning.

ANALYSIS:

The proposed changes affect Learning Domain 33 – Arrest and Control (Attachment A). The Training and Testing Specifications were updated to include body positioning that could restrict breathing (i.e., positional asphyxia). Peace officers need to be aware that  body positions used to control a subject may cause additional concerns for the subject’s physical well-being. In order to ensure the safety and to minimize the risk of an in-custody death, peace officers should learn to recognize contributing factors that may restrict breathing.

RECOMMENDATION:

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report. If no one requests a public hearing, the changes will become effective April 1, 2022.
