ISSUE:
Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed changes in the minimum standards for content and instructional hours of the Campus Law Enforcement Course?
BACKGROUND:
As part of an ongoing review of legislatively mandated courses, POST staff and curriculum consultants review course content to determine if revisions are necessary. This process is facilitated by POST and attended by selected subject matter experts. Some of the more significant outcomes of these workshops are recommendations for updating and enhancing the legislatively mandated courses under review. POST staff and subject matter experts reviewed the content of the Campus Law Enforcement Course, and recommended revisions that reflect emerging needs, compliance with legislatively mandated subject matter, changes in the law, and to improve student learning.
ANALYSIS:

The proposed changes to Commission Regulation 1081 (Attachment A) - Campus Law Enforcement Course are the result of regularly scheduled reviews. These proposed changes reflect emerging needs, compliance with legislatively mandated subject matter, changes in the law, and to improve student learning.

The proposed changes include the following:

  • Updated Role and Responsibility of School Police to include in Campus Communities - Campus police have legal authority to enforce the law outside of the grounds of their assigned school district/college campus, the intent of this course is to emphasize their role regarding the community in which they serve… specifically the school campus community.
  • Update Tactical Awareness in the Educational Environment to Operational Awareness in the Education Environment - The concepts of police tactics and or tactical awareness in a school setting related to potential threats on campus are vital in ensuring the safety of students and staff, a more appropriate, accurate and all-encompassing term for the title of this training topic is “Operational Awareness."
  • Updated Campus/Community Oriented Policing and Problem Solving to Principled Policing & Problem Solving - The goal of "Community Oriented Policing" is to reduce crime and disorder by carefully examining problems in neighborhoods, whereas ‘Principled Policing’ introduces the concept of procedural justice which aims to strengthen the relationship of trust between police and communities. It focuses on how police interact with people through dignity and respect, transparency, impartiality and giving individuals a voice, which can have positive outcomes for civilians.
  • Updated Mediation/Conflict Resolution to De-escalation Skills/Conflict Resolution - The use of mediation is important for peaceful campus operations, its intent and purpose focus on non-criminal, minor misbehaviors or disputes, such as bullying, that involve students, and may not be appropriate for police intervention. Understanding the concept and use of a schools’ mediation process or program is important for campus police, but having the ability to utilize safe and effective de-escalation skills to resolve conflicts and avoid force in situations, particularly those in a school setting, is vital.
  • Updated Standardized Emergency Management/Incident Command Systems to Emergency Operations - Reflects a more contemporary and inclusive name for its training course content.
  • Updated Dynamics of Student Behavior to Dynamics of Student Development - Reflects an emphasis on student development which provides the foundation for potential behaviors, and ultimately responses involving law enforcement.

The changes were reviewed by staff with presenters of the Campus Law Enforcement Course, who agreed with the proposed changes. 

RECOMMENDATION:
If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report. If no one requests a public hearing, the changes will become effective July 1, 2022.
