ISSUE:

Should the Commission amend Regulations 1070 and 1082 to remove the Drivers Training Simulator Subjects as a required instructor course? 

Should the Commission concur, the appropriate action would be a MOTION to approve the changes enumerated in this report.

BACKGROUND:

Instructors of any of the specialized subjects listed in California Code of Regulation 1070 (Minimum Training Standards for Instructors of POST-Certified Specialized Training) shall successfully complete a training course listed in subsection 1070(b) or complete the equivalency process outlined in subsection 1070(c). 

Instructors who teach courses using the Law Enforcement Driving Simulator are required by regulation to attend a training course.

In February 2021, the Commission voted to discontinue the use of the Driving Simulator to fulfill Driver Awareness Perishable Skills. 

Since then, three of the four presenters for Drivers Training Simulation Instructor Course have discontinued the use and disposed of the driving simulators. These presenters have also decertified their instructor course(s). The fourth presenter is currently arranging for the removal of their simulators. Numerous other presenters have since disposed of their simulators. In the last three years there have only been 3 instructor classes presented across the state totaling 15 students.  

ANALYSIS:

Staff have updated Regulation 1070 (Attachment A) to remove the Drivers Training Simulation Instructor Course. Regulation 1082 (Attachment B) has been updated to remove the topics to be covered in the instructor course.

RECOMMENDATION:

Staff recommends the revisions to Regulations 1070 and 1082 be amended pursuant to the rulemaking process and the Office of Administrative Law. If no one requests a public hearing, the amendments will become effective April 1, 2022.
