ISSUE:
Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the proposed regulation changes enumerated in this report?
BACKGROUND:

As part of an ongoing process, Commission Regulations and Commission Procedures related to basic courses are reviewed by staff to determine if revisions are necessary. This process is facilitated by staff, with input by subject matter experts and academy directors and coordinators when necessary.

An update to the basic course certification and presentation process requirements went into effect April 1, 2021. Through the process of certifying basic courses under the new requirements, staff have identified some necessary revisions that were not part of the original update. Some examples of these revisions include:

  • Providing the names and permissions levels of individuals who have access to the online testing system
  • Adding the Basic Course Attestation form under the course presentation requirements 

Additionally, necessary revisions were identified to correct inconsistencies within Commission Regulation sections. Some examples of these revisions include:

  • Clarifying which instructors need to be listed on the breakdown of positions during the certification process
  • Correcting a discrepancy between course modifications and course presentations

 

 

ANALYSIS:

The following Commission Regulations (Attachment A) are affected by the proposed revisions:

1052. Requirements for Course Certification (Refer to Commission Regulation 1059 for Basic Course Certification Requirements).

1055. Requirements for Course Presentation

1059. Requirements for Basic Course Certification

1070. Minimum Training Standards for Instructors of POST-Certified Specialized Training.

The proposed revisions will ensure presenters are providing the necessary information to POST, in a more timely manner, for certification/modification of the POST-certified courses. The proposed revisions will also alleviate confusion on instructor requirements for presenters.

RECOMMENDATION:
Staff recommends the Commission Regulations be amended pursuant to the rulemaking process and the Office of Administrative Law. If no public hearing is requested, the proposed changes will become effective July 1, 2022.
