BACKGROUND:

SB 2 Peace Officer Certification Workshops with Stakeholders

On January 11-13, 2022, and January 27, 2022, POST held two workshops to obtain input from different stakeholder groups regarding the definition of serious misconduct. Retired Chief Sylvia Moir, Dr. Brenda Buren, and retired Chief Kristen Ziman facilitated the workshops. 

SB 2 Implementation Update

In commencement of SB2, the following milestones are in process:

*Over the past few months, POST has assembled a team of staff that have held numerous implementation meetings. Those meeting addressed automation, staffing requirements, regulations, and overall processes.

*As of February 1, 2022, POST has redirected an additional two full time staff members and one part time staff member to work solely on SB2 issues, for a total of nine staff members. POST is looking into temporary options to increase the number of staffing to ensure successful implementation of this bill.

*The FY 2022/2023 budget was published January 10, 2022, which provided for funding for SB2. POST continues to work with the Department of Finance and the Legislative Analyst's Office regarding the funding requests. POST testified at both the Assembly and Senate Public Safety Subcommittee Budget Hearings in February. 

*POST staff are continuing to meet with different law enforcement agencies and peace officer groups, to collaborate and educate the agencies on the implementation of SB2. 

*POST will be presenting proposed regulation adoptions and amendments at the May 2022 Commission meeting. POST staff have determined there will be 20-25 regulation adoptions and amendments, including defining "Serious Misconduct," as required by SB2. By conducting this meeting in the Spring of 2022, it should provide POST staff with sufficient time for review by the Office of Administrative Law. Staff anticipates that all regulatory actions related to SB2 implementation will be open for public comment mid-March 2022. 

*POST anticipates having a process in place for the issuance of "Proof of Eligibility" certificates by late fall 2022. 

*POST is continuing to work with the Department of Technology to acquire an electronic platform for the collection, transmission, and storage of data by January 1, 2023.

*POST is working to develop an informational video regarding SB2. Work with the vendor is scheduled to begin in March 2022. 

*POST has begun working on the development of the 40-hour decertification training course for the Peace Officer Standards and Accountability Advisory Board members. The course will include, but will not be limited to, the following topics:

  • The Decertification Process
  • Internal Investigations
  • Evidentiary Standards
  • Use of Force Standards and Training
  • Local Disciplinary Processes

POST will implement the requirements of SB2 on January 1, 2023.
