ISSUE:

Should the Commission approve, subject to the Notice of Proposed Regulatory Action process, the revision to Commission Regulation 1005 - Minimum Standards for Training, to repeal the incorporated by reference document Training Specifications for the Investigation and Trial Preparation Course and adopt the document Training Specifications for District Attorney Investigator Transition Course to be incorporated by reference?

BACKGROUND:

At the February 8, 2018 meeting, the Commission approved a change to Commission Regulations 1005 and 1015 and Commission Procedure D-14 which changed the title of the Investigation and Trial Preparation Course to District Attorney Investigator Transition Course. In addition to the title change, the hours were reduced from 80 to 40 and the number of required learning domains was reduced to nine (9). These changes were recommended to better reflect the needs of the stakeholders and were identified by a group of subject matter experts.

When the changes to Commission Regulations 1005 and 1015 and Commission Procedure D-14 were proposed and ultimately approved, the updated Training Specifications were inadvertently left out of the proposed change.

ANALYSIS:

The proposed change to repeal the incorporated by reference document Training Specifications for the Investigation and Trial Preparation Course and adopt the document Training Specifications for District Attorney Investigator Transition Course to be incorporated by reference is necessary to correct this staff oversight and ensure presenters of the updated course have access to the most current content requirements.

RECOMMENDATION:

POST Staff recommends the Commission to approve the revisions to Commission Regulation 1005, pursuant to the rule making process and the Office of Administrative Law. If no one requests a public hearing, the amendments will be effective October 1, 2022.
