ISSUE:
Should the Commission approve the amendment to Regulation 1005d(4) to correct Objective 3.E. of Tactical Firearms and remove POST LEOKA, as a document incorporated by reference?
BACKGROUND:
At the October 22, 2020 meeting, the Commission approved the proposed amendments to Commission Regulation 1005Minimum Standards for Training and Training Procedure D-2. Upon approval from the Office of Administrative Law in March 2021, the proposed changes amended the regulation to update the minimum topic content and instructional methodology requirements for the PSP topics of Arrest and Control, Driver Training/Awareness, Tactical Firearms, and Communications. POST staff identified a need to update the wording used in one of the objectives of Tactical Firearms to more accurately reflect current best practices and terminology used and propose to amend the regulation to correct this. The POST LEOKA report was also incorporated by reference at the time of the last revision. POST staff proposes to remove this as a document incorporated by reference. 
ANALYSIS:

In conducting regular reviews of Commission Regulations, POST staff identified a need to update the wording used in one of the objectives of Tactical Firearms to more accurately reflect current best practices and terminology used. Currently, Objective 3. E. of Tactical Firearms uses the term "Shoot/No Shoot Decision-Making." POST staff proposed to amend this to state "Threat Assessment/Identification" to better align with current best practices in terminology.

Additionally, POST staff propose to amend Objective 2, of Tactical Firearms to remove the specific reference to the POST LEOKA Studies. Previously, POST conducted LEOKA studies annually however available statistics were not always timely or up to date. It was determined, circa 2010, that POST would rely on other national LEOKA studies. Due to this change, POST LEOKA Studies should be removed from reference in regulation.

 

  

RECOMMENDATION:

POST staff recommend the Commission approve the amendment to Regulation 1005d(4) to correct Objective 3.E. of Tactical Firearms and remove POST LEOKA, as a document incorporated by reference from Objective 2. of Tactical Firearms.

If the Commission concurs, the appropriate action would be a MOTION to approve the recommended changes specified in this report.
