ISSUE:
Should the Commission amend Commission Regulation 1015 - Reimbursements for Training?
BACKGROUND:

On September 30, 2021, Governor Newsom signed Senate Bill (SB) 2. SB 2 made significant changes to existing Government and Penal Codes, respectively. These changes provide for additional peace officer hiring eligibility requirements and also grants POST the mandates the certification all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

After thorough review of SB 2, POST staff determined it was necessary to amend current regulations to address the following:

- Repeal the Notice of Appointment/Termination (NOAT) form, POST 2-114 (08/2016);

- Update the method of submitting a notice of appointment; and

- Remove language indicating the NOAT may be submitted to POST by mail.

 

ANALYSIS:

After thorough review of SB 2, POST staff determined it was necessary to amend current regulations to address the deactivation of the Notice of Appointment/Termination (NOAT) form, POST 2-114 (08/2016) and update the method of verifying a peace officer's appointment for training reimbursements.

POST staff propose to amend Commission Regulation 1015 - Reimbursements for Training to remove the reference to the use of NOAT for proper peace officer appointment. This form is being repealed and will no longer be used. The form is being repealed to reflect the current practice of submitting a notice of appointment via the Electronic Data Interchange (EDI). To increase efficiency in processing and ensure appointments are made within the timeframe required, pursuant to Penal Code Section 13510.9, POST will no longer accept a notice of appointment by mail. Peace officers must be appointed through the EDI to be eligible for training reimbursement.

 

RECOMMENDATION:

POST staff recommend the Commission amend Commission Regulation 1015 - Reimbursements for Training.
