ISSUE:

Should the Commission approve staff to move forward with the rulemaking process to change the minimum training requirements for District Attorney Investigators?

BACKGROUND:

POST has received inquiries about a method to allow individuals who qualify for California law enforcement positions, to become District Attorney Investigators (DAIs).

At the October 22, 2020, Commission meeting, POST staff were directed to create an agenda item addressing the ability for individuals who have completed the Specialized Investigator’s Basic Course to be hired as District Attorney Investigators.

At the September 29, 2021 Commission meeting, Assistant Executive Director Maria Sandoval and Bureau Chief Jim Grottkau, Basic Training Bureau, provided a report regarding the comments received during the comment period and at the Public Hearing.

The Commission considered all comments that were received during the 45-Day Public Comment Period and the Public Hearing and the Commission approved staff to continue the rulemaking process through the Office of Administrative Law.

ANALYSIS:

POST staff, at the request of OAL, withdrew the rulemaking file in order to add additional information through a 15-day notice process.

Attached to this item are all additional comments received during the 15-day comment period to be taken under consideration by the Commission. All written comments received during the public comment period, which pertain to the Addendum-Initial Statement of Reasons will be reviewed, responded to, and included as part of the rulemaking file. The Addendum-Initial Statement of Reasons has been attached to this item for informational purposes.    

RECOMMENDATION:

Staff recommends that the revisions to Commission Regulation 1005(a) continue to be amended pursuant to the rulemaking process and the Office of Administrative Law.
