ISSUE, BACKGROUND, ANALYSIS, & RECOMMENDATION
ISSUE:
Should the Commission authorize the Executive Director to enter into contracts with qualifying entities for the presentation of the Supervisory Course in an amount not to exceed $1,375,649.81?
BACKGROUND:

Every POST participating peace officer promoted, appointed, or transferred to a first-level supervisory position shall satisfactorily complete a POST-Certified Supervisory Course either 12 months prior to promotion or within 12 months after the initial promotion, appointment, or transfer to such position. 

The 80-hour course curriculum satisfies mandates for Use of Force intervention and mandatory reporting of Use of Force legislation, Hi Tech Crime investigations regarding Penal Code Section 1546.1, and CalVCB (victim reimbursement).

In addition, this course includes Leadership, Internal Affairs Investigations, Principled Policing, and Cultural Diversity components.

ANALYSIS:

Maximum budget expenditures are described in Attachment A – Supervisory– Maximum Expenditures.

Contract History is described in Attachment B – Supervisory – Contract History.

Individual contractor budgets are attached.

The proposed budget increased from the previous Fiscal Year.

The increase from FY 21/22 to FY 22/23 is necessary to support the need for:

  • Adding 5 returning presenters for a total of 14
  • Asking each presenter for a budget that meets their needs (in the past each presenter has operated with a $6,930.00 budget without any increase while costs have risen).
  • The cost of $6930.00 never covered the actual cost of presenting the Supervisory Course and the new numbers reflect the actual cost of presenting the course. POST will now be reimbursing presenters with their actual cost of presenting the Supervisory Course. Students will no longer be required to pay tuition.

 

There are various distinctions among budgets due to the following reasons:

  • 7 out of 14 presenters host the Supervisory Course at a hotel meeting room(s), resulting in a higher cost than presenters that use their own facilities with little or no cost. The decision to present at a hotel is based on the availability of facilities. Many presenters do not have facilities that can accommodate this course and utilize hotels. In addition, these hotels are selected at centralized locations which will reduce the travel of the participants. Any presenter utilizing their own meeting facilities may charge a reasonable fee or offer as an in-kind donation. The determining factors resulting in facility cost differences is due to the on-going business relationship with hotels and regional market rate.
  • All presenters utilize coaching/evaluators and role players.  Presenters who have in-kind donations of salary and time to cover the coaching and role/playing required in this course will show zero cost for these positions.
  • Salaries for Facilitators/Instructors vary with all presenters, ranging from $60 to $90 an hour. These salaries are based on experience as well as the rank of the individual facilitating the course. Some presenters are affiliated with a college and the salaries are based on the tenure of the college employee's.  Program Managers’ and Coordinators’ salaries may also vary from $55 to $90 an hour based on their current salaries.
  • Some presenters purchasing policy allows procurement from more cost-efficient locations such as internet-based companies. Other presenters are obligated to abide by contracted agreements with small businesses that traditionally carry a higher cost. In addition, some college presenters must utilize the current vendors who have contracts with the college.
  • 8 out of 14 presenters have Guest Presenters who facilitate a portion of the 80-hour course due to their subject matter expertise. Subjects include but are not limited to psychologists to facilitate the Stress Management portion of the course, or attorneys to facilitate the liability issues, including the Police Officer Bill of Rights (POBR). In addition, subject matter experts are brought in to present how to complete an Internal Affairs investigations.  Presenters with no guest presenters utilize subject matter experts who are already in their teaching cadre.
  • Large agencies such as LAPD, San Bernadino, Riverside Sheriff, and LASD are forecasting attrition among Peace Officers and the promotion of Sergeants.  The presenters have added additional presentations in 22/23 to accommodate.

Supervisory Course was placed on Plan V for this fiscal year only, it will expire June 30, 2022.

RECOMMENDATION:
POST staff recommends the Commission authorize the Executive Director to enter into contracts with a qualifying entities for the presentation of the Supervisory Course in an amount not to exceed $1,375,649.81.
