Under Government Code section 11123(a), all meetings of a state body are open and public, and all persons are permitted to attend any meeting of a state body, except as otherwise provided in that article. Pursuant to Executive Order N-29-20, certain provisions of the Bagley-Keene Open Meeting Act are suspended due to a State of Emergency in response to the COVID-19 pandemic. 7.Report on POST Continuity of Government during Coronavirus (COVID-19) Pandemic

Executive Order N-63-20 requires the POST Executive Director to inform the Commission whenever temporary waivers are issued in relation to Regulations 1005 (Minimum Standards for Training), 1008 (Basic Course Waiver and Requalification Requirement), and 1070 (Minimum Training Standards for Instructors of POST-Certified Specialized Training).

8.Report on POST Workforce Diversity Stats

The Commission requested diversity data for the POST workforce be included at the next Commission meeting. This report includes the data listed below.

9.Report on Crowd Management

Staff worked with subject matter experts (SMEs) and other contributors on an aggressive timeline to update and revise the 2012 Crowd Management, Intervention and Control Guidelines. This is a report on the status of that project.

10.Report on Assembly Bill No. 332 Peace Officers: Training

In response to Assembly Bill (AB) 332, POST staff conducted a correlational research study to explore the relationship between whether a specific group of students tend to pass or fail the academy. The bill required the collection of comprehensive data to address the various mandated information in AB 332, which includes, but is not limited to the gender and race of each student in relation to the success rate of the Regular Basic Course (RBC).

 

The report was delivered to the Legislature in March 2021, and is available for the public to review on the POST website.

12.Report on Update of 1070 Instructor Refresher Training

POST staff will provide an informational presentation to the Commission on its research into requiring instructors in certain courses identified in Regulation 1070, to attend mandated refresher courses after a designated time frame.

13.Report on POST Proposed Regulatory Actions/Status

The Commission has asked for staff to present ongoing reports on the status of regulatory actions once they have been approved by the Commission. This report reflects the progress of such actions as they move through the regulatory process.

FINANCE COMMITTEE
C.Financial Report


The Chair of the Finance Committee will report on the results of the Finance Committee held on Wednesday, June 2, 2021, in West Sacramento, California.
 
If the Commission concurs, the appropriate action would be a MOTION to approve the Finance Committee Report from their meeting on Wednesday, June 2, 2021, in West Sacramento, California.

 

And, if the Commission concurs the appropriate action would be a ROLL CALL VOTE by groups of contracts to authorize the Executive Director to renew Law Enforcement Training and Administrative Contracts. 


BASIC TRAINING BUREAU
D.Report on Proposed Changes to the Minimum Training Requirements for District Attorney Investigators - Commission Regulation 1005

The proposed revision to Commission Regulation 1005(a) amends the training requirement for District Attorney Investigators to include completion of either the Regular Basic Course (RBC) or the Specialized Investigators' Basic Course (SIBC).

 

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report. The proposed changes are subject to the rulemaking process with a proposed effective date of January 1, 2022.

 

E.Report on Revision to the Testing and Notification Requirements for Basic Course Presenters - Commission Regulations 1005, 1007, and 1008; and Commission Procedure D-1

As part of an ongoing process, staff reviews regulations and procedures related to basic courses to determine if revisions are necessary. 

 

POST staff is proposing a revision to Commission Regulations 1005, 1007, 1008, and Commission Procedure D-1 which will require presenters to notify a student’s employing agency following an initial test failure. 

 

In addition, POST staff is proposing that the presenter be required to notify the Basic Training Bureau when 15% or more of the students attending the course fail any POST-required scenario or exercise test, to include both initial test(s) and retest(s).

 

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report.

 

F.Report on Proposed Changes to the Training and Testing Specifications for the Requalification Course

As part of an ongoing process, basic course content is reviewed to determine if revisions are necessary. POST held a workshop in March 2021 with course presenters and subject matter experts (SMEs) to review the content of the Requalification Course. POST staff are proposing revisions to the course content as a result of this review.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report. The proposed changes are subject to the rulemaking process with a proposed effective date of April 1, 2022.


TRAINING PROGRAM SERVICES BUREAU
G.Report on Request to Amend Regulation 1081 - Requirements for Human Trafficking

A discrepancy was discovered while POST staff was conducting a review of POST Regulations. Regulation 1081 indicates law enforcement officers voluntarily participate in Human Trafficking Training courses. California Penal Code 13519.14(e) states every law enforcement officer shall complete Human Trafficking Training courses.

 

The proposed change to Regulation 1081 will resolve the inconsistency and align the Regulation with statute.

If the Commission concurs, the appropriate action would be a MOTION to approve the changes as described in the staff report.

  • Request to appoint Juan Viramontes, President, Association of Orange County Deputy Sheriffs, to the Advisory Committee by the California Coalition of Law Enforcement Associations (CCLEA) Board of Directors as a replacement representative for Senior Deputy Coroner Artin Baron.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the appointment of Juan Viramontes as a member of the POST Advisory Committee.

 

  • Request to appoint Lieutenant Eric Swift, Napa County Sheriff's Department, to the Advisory Committee by the California Peace Officers Association (CPOA) Board of Directors as a replacement representative for Chief David Honda. 

 

If the Commission concurs, the appropriate action would be a MOTION to approve the appointment of Lieutenant Eric Swift as a member of the POST Advisory Committee.

 

2. Executive Director Performance Review - September 1, 2021
