Under Government Code section 11123(a), all meetings of a state body are open and public, and all persons are permitted to attend any meeting of a state body, except as otherwise provided in that article.

The Commission meeting will be conducted in-person at POST Headquarters, located at 860 Stillwater Road, Suite 100, West Sacramento, CA 95605, in Training Rooms A & B (upstairs). Members of the public who wish to comment during the public comment portion of the meeting may do so in person by attending the meeting. Members of the public who wish to observe the meeting may view the meeting streamed live on the Commission webpage at https://post.ca.gov/Watch-Meeting.

A.Report on Amendment to Commission Regulation 1953 - Peace Officer Background Investigation

On September 30, 2021, Governor Newsom signed Senate Bill (SB) 2. SB 2 made significant changes to existing Government and Penal Codes, respectively. These changes provide for additional peace officer hiring eligibility requirements and also grants POST the authority to certify all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the proposed amendments to the regulation specified in this report.

 

B.Report on Amendment to Commission Regulations 1003 and 1012

On September 30, 2021, Governor Newsom signed Senate Bill (SB) 2. SB 2 made significant changes to existing Government and Penal Codes, respectively. These changes provide for additional peace officer hiring eligibility requirements and also grants POST the authority to certify all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the proposed amendments to the regulations specified in this report.

 

If the Commission approves the first motion and concurs, the appropriate action would be a MOTION to approve the modified proposed changes to POST 2-357, Affidavit of Separation form as specified in this report.

 

C.Report on Amendment to Commission Regulation 1015 - Reimbursements for Training

On September 30, 2021, Governor Newsom signed Senate Bill (SB) 2. SB 2 made significant changes to existing Government and Penal Codes, respectively. These changes provide for additional peace officer hiring eligibility requirements and also grants POST the authority to certify all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the proposed amendments to the regulation specified in this report.

 

D.Report on Amendment to Commission Regulations 1007, 1010, 1011, and Adopt Commission Regulation 1202

These changes provide for additional peace officer hiring eligibility requirements and also grants POST the authority to certify all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the proposed amendments and adoption to the regulations specified in this report.

 

E.Report on Amendment to Commission Regulation 1001 - Definitions, Adopt Commission Regulation 1201 - Definitions Related to Peace Officer Certification

On September 30, 2021, Governor Newsom signed Senate Bill (SB) 2. SB 2 made significant changes to existing Government and Penal Codes, respectively. These changes provide for additional peace officer hiring eligibility requirements and also grants POST the authority to certify all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the proposed amendment to current and adoption of new regulations specified in this report.

 

If the Commission approves the first motion and concurs, the appropriate action would be a MOTION to approve the modified proposed text changes of Commission Regulation 1001 specified in this report. 

 

F.Report on Adoption of Commission Regulation 1205 - Serious Misconduct

On September 30, 2021, Governor Newsom signed Senate Bill (SB) 2. SB 2 made significant changes to existing Government and Penal Codes, respectively. These changes provide for additional peace officer hiring eligibility requirements and also mandates POST to certify all peace officers in California, and subsequently take action against those certifications, should the POST Commission determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

A portion of the bill mandates the POST Commission to define "serious misconduct."

 

If the Commission concurs, the appropriate action would be a MOTION to approve the proposed adoption to the regulation specified in this report.

 

G.Report on Adoption of Commission Regulations 1203, 1204, 1206, 1207, 1208, 1209, and 1210

On September 30, 2021, Governor Newsom signed Senate Bill (SB) 2. SB 2 made significant changes to existing Government and Penal Codes, respectively. These changes provide for additional peace officer hiring eligibility requirements and also grants POST the authority to certify all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the proposed adoptions to the regulations specified in this report.

 

If the Commission approves the first motion and concurs, the appropriate action would be a MOTION to approve the modified proposed text changes to Commission Regulation 1206 specified in this report. 

 

H.Report on Adoption of Commission Regulations 1211, 1212, and 1214

While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the adoptions of the regulations specified in this report.

 

I.Report on Adoption of Commission Regulation 1213 - Suspension of Peace Officer Certification

These changes provide for additional peace officer hiring eligibility requirements and also grants POST the authority to certify all peace officers in California, and subsequently take action against those certifications, should POST determine serious misconduct occurred. While the peace officer eligibility hiring requirements went into effect on January 1, 2022, the remaining changes to Government and Penal Codes will go into effect on January 1, 2023.

 

If the Commission concurs, the appropriate action would be a MOTION to approve the adoption of the regulation specified in this report.
